HomeMy WebLinkAboutORD 1970-363BILL N0. 75fi COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE N0. 3~~ AN ORDINANCE AMENDING ORDINANCE N0. 38 OF THE REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED, PROVIDING FOR THE REGULATION AND CONTROL OF TAXICAB DRIVERS AND TAXIMETERS, ESTABLISHING TAXICAB RATES AND FARES, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 2 of Ordinance No. 38, Revised Ordinances of the County of Hawaii 1967, as amended, is hereby amended by deleting Subsection (c) and re-numbering Subsection (d) to Subsection (c). SECTION 2. Section 3 of Ordinance No. 38, Revised Ordinances of the County of Hawaii 1967, as amended, is hereby amended by deleting Subsection (d) and re-numbering Subsection (e) to Subsection (d). SECTION 3. Ordinance No. 38, Revised Ordinances of the County of Hawaii 1967, as amended, is hereby further amended by adding a new section to be numbered Section 10 and re-numbering the former Section 10 to Section 11. The new Section 10 shall read as follows: "SECTION 10. LIMITATION IN NUMBER OF TAXICABS. (a) Basis. The number of taxicabs authorized to be licensed to operate in the County of Hawaii shall be limited on the basis of one taxicab for each 1200 resident population. (b) The resident population for the county shall be estimated annually by the Department of Research and Development of the County of Hawaii as of July 1st. (c) If the annual count of population permits an increase in the number of taxicabs, the Director of Finance shall publish a notice in the newspaper of the additional number of taxicabs permitted and shall award the additional taxicab licenses to interested applicants from licensed taxicab owners by public drawing. If the population count is lower than the previous r,. year, the maximum number of taxicabs allowed will be adjusted but those already licensed will be permitted to continue operating. (d) Any taxicab licensed to operate as of the effective date of this Ordinance shall be permitted to continue operating in spite of any limitation to the contrary. (e) Nothing in this Ordinance shall be construed to prevent the replacement or substitution of a licensed taxicab by another vehicle or prevent the sale of a taxicab." SECTION 4.
