HomeMy WebLinkAboutORD 1971-393BILL N0. 7g3 (Revised) COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE N0. a393 AN ORDINANCE AMENDING ORDINANCE N0. 350, RELATING TO IMPROVEMENTS BY ASSESSMENTS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 1.3 of Ordinance No. 350 (1970) is hereby amended to read as follows: "SECTION 1.3 Storm Drainage System. "The term 'storm drainage system' whenever used in this ordinance includes 'sanitary sewerage system.' For the construction of sanitary sewerage systems, the specially benefited area of the lands within an improvement district shall be assessed, except as hereinafter provided, at the following rates: 6 cents per square foot for agricultural, parks and recreation, preservation, public facilities and utilities, military and cemetery general planned areas; $ cents per square foot for residential; 10 cents per square foot for commercial and industrial general planned areas; and 12 cents per square foot for hotel, apartment, resort- hotel and public housing general planned areas. The balance of the cost shall be borne by the County. Anything herein to the contrary notwithstanding, if the construction of any such system is initiated pursuant to Section 3.3 or Section 3.4, the total cost of such system shall be assessed against the lands specially benefited. "In case of a sanitary sewerage system proposed to be constructed or improved independently of other improvements, such improvement district raay embrace two or more geographically separate or noncontiguous areas; provided that such separate or noncontiguous areas utilize one common trunk line or interceptor sewer in the disposal of sewage from such areas." SECTION 2. This ordinance shall become effective upon its approval. This Bill proposes to amend Section 1.3 of Ordinance No. 350 (1970), Storm Drainage System, by stating that the term 'storm drainage system' whenever used in this ordinance includes 'sanitary sewerage system.'
