'~~~ AN ORDINANCE AMENDING SECTION 30 OF ORDINANCE N0. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 30 of Ordinance No. 63 of the Revised. Ordinances of the County of Hawaii 1967, as amended, is hereby amended by adding a new subsection G to Section 30 to read as follows: "G. SHORELINE SETBACK LINE 1) Definitions: a. 'Shoreline' means the upper reaches of the wash of waves, other than storm and tidal waves, usually evidenced by the edge of vege- tation growth, the upper line of debris left by the wash of waves. b. 'Shoreline setback' means all of the land area between the shoreline and the shoreline setback line. c. 'Shoreline setback line' means that line estab- lished by the State Land Use Commission or the County running inland from and parallel to the shoreline at a horizontal plane. 2) Shoreline setback lines are established throughout the County of Hawaii by the State Land Use Commission at forty (40) feet inland from the upper reaches of the wash of waves other than storm and tidal waves except that such shoreline setback lines shall be twenty (20) feet on any land parcel of record when any one or more of the following exists: a. Where the average depth of a parcel as measured from the shoreline or the seaward boundary of the parcel whichever is the less, is less than one hundred (100) feet; b. Where the parcel is less than one-half (1/2) acre and where that parcel area is less than the minimum lot area required by the respective County Zoning or Subdivision Ordinance appli- cable to said parcel; or c. Where the buildable area of the parcel is reduced to less than fifty (50) per cent of the parcel after applying the forty (40) foot shoreline setback line and all State and County requirements wherein the parcel is located including but not limited to front and side yard setbacks, cross-slope requirements, and terrain requirements." SECTION 2. This ordinance shall take effect upon its approval. No Bill No. 795 - 1971 AN ORDINANCE AMENDING SECTION 30 OP ORDINANCE N0. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED, This Bill proposes to amend Section 30, General Provisions, Exceptions and Supplementary Regulations, by the addition of a new subsection G, Shoreline Setback Line, and providing for the definitions of shoreline, shoreline setback and shoreline setback line; further, establishes shore- line setback lines throughout the County of Hawaii by the State Land Use Commission at forty (40) feet inland from the upper reaches of the wash of waves other than storm and tidal waves except that such shoreline set- back lines shall be twenty (20) feet on any land parcel of record when any one or more of the following exists: a. Where the average depth of a parcel as measured from the shoreline or the seaward boundary of the parcel whichever is the Less, is less than one hundred (100) feet; b.
