HomeMy WebLinkAboutORD 1971-426BILL N0. $19 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE N0. ~''^~I AN ORDINANCE ESTABLISHING THE NUMBER AND RATES OF COMPENSATION FOR ALL POSITIONS IN DEPARTMENTS, OFFICES AND OTHER AGENCIES OF THE COUNTY OF HAWAII UNDER THE LEGISLATIVE CONTROL OF THE COUNTY COUNCIL, DESIGNATING PAYROLL PERIODS, PAY DAYS, PRESCRIBING CERTAIN REQUIREMENTS WITH RESPECT TO OVERTIME, PERQI!ISITES AND OFFICIAL FIDELITY BONDS, AND REPEALING ORDINANCE 333, AND ALL AMENDMENTS THERETO; SAID ORDINANCE TO BE KNOWN AS THE SALARY ORDINANCE OF 1971. BE IT ORDAINED BY THE COUNTY COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Declaration of policy. It is [he purpose of this ordinance to fix and establish the number and rates of compensation ~or all positions in departments and offices of the County of Hawaii under the legislative control of the County Council pursuant to the provisions of Section 3-14, County Charter, and chapters 76 and 77 of the Hawaii Revised Statutes. This ordinance also covers other matters relating to compensation of county employees. The term "Employees" as used in [his ordinance shall include all officers. SECTION 2. Payroll periods; pay days; fractional computation. All salaries and wages shall be earned and payable in semi-monthly payroll periods, from the first (1st) to the fifteenth (15th) of each month and from the sixteenth (16th) to the end of each month; The fifteenth (15th) day and last day of each month shall be the pay days for all employees; In the case where the required service has been rendered during a full payroll period, one-half (1/2) of the monthly rate shall be paid; When, for any reason, any employee is not entitled to receive the full amount of his semi-monthly installment of salary for any payroll period, the salary which he shall receive for such period shall be computed by dividing the semi-monthly installment by [he number of days in such period and by multiplying the result thereof by the number of days and/or fraction of days for which pay is due. The Director of Finance shall be authorized to approve payroll claims covering compensation for fractional parts of a month computed otherwise than in accordance with the foregoing requirements, in cases where compliance with such requirements would result in hardship or unfairness to the employees involved. SECTION 3. Overtime. Any employee who is authorized by his department head [o perform during any payroll period overtime services in excess of the maximum number of hours set by applicable provisions of the Hawaii Revised Statutes and any act amendatory thereto, or any rule or regulation passed in pursuance thereof, shall be entitled to compensatory time-off for work in excess of the required maximum number of hours at the rate of one and one-half hours for each hour of overtime work. Overtime shall be granted in terms of compensatory time-off as mutually agreed to with his appointing authority or in cash payment within forty-five (45) days after the overtime work is performed if the employee does not elect compensatory time credit in lieu of cash payment. SECTION 4. Rate of compensation. (A) The monthly rates of compensation for positions covered by the position classification plan shall be determined and fixed in accordance with the provisions of chapter 77 of the Hawaii Revised Statutes as amended by Act 127, Session Laws of Hawaii 1969, and Ac[ 11A, Session Laws of Hawaii 1970, based on the salary schedule with longevity increase as set forth below, providing that non-civil servants holding such positions shall be entitled to increments and longevity increases in the same manner as civil servants. -2- STF.'1'F OE ILaI~.Il SG}ICl'r'11.1,'. SECTION 5. Employment governed by budget and appropriation. Employees to fill the positions enumerated herein are to be employed as needed and as specified in the respective applicable department budgets approved for the year, or in ordinances or resolutions supplemental thereto, to the extent that funds are available and appropriated by the County Council as provided by law. SECTION 6. Emergency Employment. When an emergency exists in the opinion of the Mayor, and additional labor or service, not provided for by this ordinance, is needed by the county to care for such emergency, the Mayor is authorized to appoint to a position or employment with the county any such person or persons as he deems necessary at rates within the ranges of compensation prescribed herein, which are comparable to the rates established hereunder in view of the labor or service to be performed, to care for such emergency; provided, however, that no person shall be so appointed unless at the time of appointment of such persons there shall be available legally expendable funds sufficient for his compensation. In the event the Mayor appoints any person or persons to positions or employment under this section he shall report the same co the County Council at its next regular meeting. SECTION 7. Perquisites. That, pursuant to provisions of Section 77-16, Hawaii Revised Statutes, each department head shall determine, subject to the approval of the Mayor and under such directives as he may issue, the reasonable value of allowance rendered to employees in the form of quarters, heat, light, household equipment, and maid service, laundry service or other perquisites at the expense of [he county but not for the convenience or benefit of the county and -10- cause the reasonable value of such allowances to be deducted from the compensation of such employees. The department shall notify the employees concerned of its findings and transmit the same co the Director of Personnel Services and the Director of Finance. SECTION A. Official Fidelity Bonds. Pursuant to the provisions of Sections 62-7 to 62-9, Hawaii Revised Statutes, and any act amendatory thereto, or any provision passed in pursuance thereto by the County Council, official fidelity bonds, filed and approved in the form and manner set forth in Sections 46-26 and 46-2R, Hawaii Revised Statutes, shall be required of the persons appointed to or occupying certain positions enumerated in the above sections; said bonds shall be in the custody of the Director of Finance, excepting the bond of the Treasurer which shall be in the custody of the Mayor. SECTION 9. That the number and rates of compensation for all positions in departments and offices of the County of Hawaii under the legislative control of the County Council of the County of Hawaii be and the same are hereby fixed and established, in accordance with schedules as set forth in Section 4 of this Ordinance, as follows: SECTION 9.01. The positions and rates of compensation adopted in the 1971 budget of the County of Hawaii are hereby ratified and confirmed as of July 1, 1971; and that any creation, reallocation of positions, salary range reassignment or other changes of pay subsequent to the adoption of said budget, shall take effect as authorized on the date of such creation, reallocation, salary range reassignment or change of pay or a date otherwise prescribed, subject to the certification of availability of funds by the Director of Finance. SECTION 11. Ordinance 333 and any resolutions amendatory thereto are hereby repealed. SECTION 12. The repeal of the ordinance, enumerated in Section 11 above, shall not affect any act done, ratified or confirmed, or any right accruing and accrued or established, or any action, suit or proceedings had or commenced in any several cause prior to said repeal, but all rights and liability under said -31- ordinance hereinabove repealed shall continue and may be enforced in the same manner and with the same force as if said repeal had not been made. SECTION 13. Severability. If any section, or any part or clause of any section, of this ordinance be decided by the Courts to be unconstitutional or invalid, the same shall noc affect the validity thereof which can be given effect without that so decided to be unconstitutional or invalid. SECTION 14. This ordinance shall be known as the Salary Ordinance of 1971 and shall take effect as of July 1, 1971.
