ORDINANCE N0. ~'Z1~
AN ORDINANCE AMENDING ORDINANCE NO. 350, AS AMENDED, RELATING TO IMPROVEMENTS
BY ASSESSMENT, RY AMENDMENTS AND ADDITIONS OF SUBSECTIONS TO ARTICLE I, GENERAL
PROVISIONS.
BE IT ORDAINED BV THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 1.1, Definitions, of Article 1 (General Provisions),
Ordinance No. 350 (Improvements by Assessment), as amended, is further amended
to read as follows:
"(d) The terms or expressions 'Special Improvement,' 'Improvement,'
the 'Making of a Special Improvement, "Make any Special Improvement' and
equivalent expressions, mean and include any one or more or any combination
of any of the following:
(1) The establishment, opening, extension, widening or altering
of any street, alley or other highway, or sidewalk;
(2) The grading, paving, curbing, macadamizing or otherwise
improving of the whole or any part of any existing public street, alley,
or other highway or sidewalk;
(3) The construction of a storm drainage system;
(4) The construction of any sanitary sewerage system;
(5) The construction of a street lighting system;
(6) The construction of a water system;
(7) The construction and installation of underground utility
facilities and the removal, relocation, replacement or reconstruction of
the utility facilities required to be placed underground.
(B) The establishment, extension, construction of public
off-street parking facilities, pedestrian mall, parks, playgrounds, beach
areas, or other public recreational areas and facilities;
(9) To otherwise improve any of the foregoing to an extent
exceeding maintenance or repair thereof.
"(e) 'Cost' means the cost, either estimated or actual, as the case
may be of the improvements to be opened, constructed, or improved in
proceedings taken pursuant to this ordinance for which assessments are to
be levied. There may be included within the definition of 'cost' amounts
for construction contingencies, bond discounts, reserve funds, and inci-
dentals.
"(f) 'Incidentals' mean expenses in carrying out proceedings pursuant
to this ordinance for preparation of maps, notices, and other documents;
posting, mailing and publication costs; preparation and printing of bonds,
bond registers and transfer books; fees of financial, legal, engineering
and surveying consultants; and such other miscellaneous expenses which
relate directly to the proceedings."
SECTION Z. This ordinance shall take effect upon its approval.
