OF HAWAII ORDINANCE N0. ~4'r~ AN ORDINANCE AMENDING SECTION 7.02, THE NORTH KONA ZONE MAP, ORDINANCE N0. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-3a) TO AGRICULTURAL (A-1a) IN KAhOKO, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-3-08:68. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.02 of Ordinance No. 63 (Zoning Ordinance), Revised Ordinances of the County of Hawaii 1967, as amended, is hereby further amended by adding thereto the following subsection: "7.02 (n). The district classification of the following area situated at Kaloko, North Kona, Hawaii, shall be Agricultural (A-1a): Beginning at a nail in concrete at the Northwest corner of this lot, and being also the Southwest corner of Lot 2D (2), and on the Easterly side of Mamalahoa Highway, the coordinates of said point of beginning referred to Government Survey Triangulation Station "MOANUTAHEA" being 16,851.96 feet South and 7,608.21 feet West, thence running by azimuths measured clockwise from true South: 1. 258° 13' 45° 885.88 feet along Lot 2D (2) and 40 foot Road Reserve to a pipe in concrete; 2. 345° 06' 553.29 feet along Lot 2E to a pipe in concrete; 3. 78° 03' 30" 153.23 feet along Honokohau 1st-Kaloko Boundary along R. P. 75$7, L. C. Aw. 11216, Ap. 36 to M. Kekauonohi to a pipe in concrete; 4. 84° 03' 30" 180.03 feet along Honokohau 1st-Kaloko Boundary along R. P. 7587, L. C. Aw. 11216, Ap. 36 to M. Kekauonohi to a pipe in concrete; 5. 61° 57' 30" 116.94 feet along Honokohau 1st-Kaloko Boundary along R. P. 7587, L. C. Aw. 11216, Ap. 36 to M. Kekauonohi to a pipe in concrete; 6. 73° 42' 144.01 feet along Honokohau 1st-Kaloko Boundary along R. P. 7587, L. C. Aw. 11216, Ap. 36 to M. Kekauonohi to a pipe in concrete; 7. 162° 30' 287.10 feet along R. P. 6938, L. C. Aw. 9160 to Kanu to a pipe in concrete; 8. 66° 20' 541.20 feet along R. P. 693$, L. C. All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the condition that the applicant, land owner or lessee, of the subject land shall submit an application for subdivision within one year of the date of approval by the Council; and if said condition is not complied with, the Planning Commission shall reserve the right to review the application for possible down-zoning. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the parts of this ordinance. SECTION 4.
