AN ORDINANCE AMENDING SECTION 7.04, THE KAILUA URBAN ZONE MAP, ORDINANCE N0. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE FAMILY RESIDENTIAL (RS-15) TO MULTIPLE FAMILY RESIDENTIAL (RM-1.25) IN PUAA 2ND, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-5-09:56. BE IT ORDAINED BY THE COUNCIL IN AND FOR THE COUNTY OF' HAWAII: SECTION 1. Section 7.04 of Ordinance No. 63 (Zoning Ordinance), Revised Ordinances of the County of Hawaii 1967, as amended, is hereby further amended by adding thereto the following subsection: "7.04 (f). The district classification of the following area situated at Puaa 2nd, North Kona, Hawaii, shall be Multiple Family Residential (RM-2): Beginning at a spike in concrete at the southwest corner of this parcel of land, the coordinates of which referred to "KAILUA" being 4,020.33 feet South and 2,653.56 feet East, and thence running by azimuths measured clockwise from true South: 1. 151° 59' 102.40 feet along the easterly side of Kuakini Highway, to a spike in concrete; Thence along stonewall, along Lot 2_, along Grant 4.100 Apana 2 to Papa, as per R. M. Towill Corporation's survey dated December 29, 1961, for the following three (3) courses: 2. 2560 58' 212.96 feet to a pipe in concrete; 3• 254° 02' 30" 178.70 feet to a spike in concrete; 4. 257° 22' 115.60 feet to a "+" cut on set rock at centerline inter section of stonewalls (fo und), thence; 5• 342° 58' 127.88 feet along Kuakini Great Wa11, along Grant 1744 to Kahaunaele, to a pipe in concrete; 6- 79° 20' 45" 489.89 Peet along remainder of Grant 4037, Apana 2 to J. Kaaeamoku, to the point of beginning and conta ining an area of 1.286 Ac res. "All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the development comply with the goals, policies, and standards of multiple residential development as outlined in the general plan document and (B) the applicant or owner or lessee of 'the property be responsible for obtaining a building permit, substantially conforming to the preliminary building plans submitted in conjunction with the rezoning application, within one year from the date of approval of this request. Should this condition not be met, the Planning Commission shall reserve the right to initiate rezoning proceeding to its original designation. SECTION 3, In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of tkiis ordinance. SECTION 4, This ordinance shall take effect upon its approval.
