Home My WebLink AboutORD 1972-480BILL NO. ~~` COIDNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO, ~~~~ AN ORDINANCE AMENDING SECTION 7.29, THE CITY OF HILO ZONE MAP, ORDINANCE NO. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING THE DISTRICT' CLASSIFICATION FROM AGRICULTURAL (A-3a) TO SINGLE FAMILY RESIDENTIAL (RS-15) IN W~RKEA HOMESTEADS, WAIAKEA, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEY 2-4-03:23. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.29 of Ordinance No. 63 (Zoning Ordinance), Revised Ordinances of the County of Hawaii 1967, as amended, is hereby fiurther amended by adding thereto the following subsection: "7.29(g). The district classification of the following area situated at Waiakea Homesteads, Waiakea, South Hilo, Hawaii, shall be Single lYamily Residential (RS-15): Beginning at an iron pipe at the southeast corner of this lot, the southwest corner of Lot 620 and on the north side of Kawailani Street the coordinates of said point of beginning referred to Government Survey Triangulation Station "HALAI" being 12360.8 feet South and 543.7 feet West, as shown on Government Survey Registered Map No. 2650, and running by true azimuths: 1. 85° 40' 968.0 feet along the North side of Kawailani Street to an iron pipe; 2. 175° 40' 1840.0 feet along Lot 622 to an iron pipe; 3. 265° 40' 968.0 felt along Lot 521 to an iron pipe; 4. 355° 40' 1840.0 feet along Lot 620 to the point of beginning and containing an area of 40-89/100 Acres. "All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof." SECTION 2. =Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the area be incrementally zoned in two (2) increments. The first increment shall consist of fifty-eight (58) lots and the second increment the remaining lots. The effective date of zoning for the second increment shall be after development has occurred on the first zoning increment. Development is defined as building permits issued for residential dwelling units and construction partially completed-- partially completed in the sense of having roofs on those units--on a minimum of twenty-four (24) dwelling units of the first increment. This is to assure that a minimum of twenty-five (25) per cent housing construction would occur on the total subdivisions; and (~) the owner or lessee of the subject property submit a subdivision plan for preliminary approval within one (1) year fvmmtthe date of approval of the change of zone. Should this condition not be met, the Planning Commission shall reserve the right to initiate action to rezone the subject property to its former zoning designation. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. ffi5~$s ordinance shall take effect upon its approval. This bill proposes to amend the City of Hilo Zone Map by changing the district classification for approximately 40.41 acres of land situated in Waiakea Homesteads, Waiakea, South Hilo, from an A-3a to a RS-15 zoned district.
