HomeMy WebLinkAboutORD 1972-483BILL N0. $$3 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE N0. ~}~~ AN ORDINANCE AMENDING SECTION 7.02, THE NORTH KONA ZONE MAP, ORDINANCE N0. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM UNPLANNED (U) TO AGRICULTURAL (A-1a) IN HAMANAMANA, NORTH KONA, HAWAII COVERED BY TAX MAP KEY 7-3-G3:5. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.02 of Ordinance No. 63 (Zoning Ordinance), Revised Ordinances of the County of Hawaii 1967, as amended, is hereby further amended by adding thereto the following subsection: "7.02_ (s). The district classification of the following area situated at Hamanamana, North Kona, Hawaii, shall be Agricultural (A-1a): Beginning at the southwest corner of this parcel of land at the northerly boundary of Grant 3027 to Heueu the coordinates of said point of beginning referred to Government Survey Triangulation Station "MOANUTAHEA" being 3776.41 feet South and 12,435.97 feet West and running by azimuths measured clockwise from true South: o , 1. 181 20 645.71 feet along mauka side of a 20 feet road; 2. 270° 25' 1936.29 feet along South side of a 20 feet road, along Haleohiu; 3. 359° 00" 590.00 feet along Lot 43, Grant 3969 to Piimauna; 4. 88° 47' 08" 1962.00 feet along Grant 3027 to Heueu to the point of beginning and containing an area of 27.64 Acres more or less. All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the area be zoned in two (2) increments. The first increment shall consist of fourteen (14) lots, and the second increment shall consist of the remaining lots. The effective date of zoning for the second increment shall be after development has occurred on the first zoning increment. Development is defined as building permits issued for residential dwelling units and construction partially completed--partially completed in the sense of having roofs on those units on six (6) or forty-three(43) percent of the lots in the first increment. This is to assure that a minimum of twenty-five (25) percent housing construction would occur on the total area requested; and (B) the owner or lessee of the subject area submit a subdivision plan and secure preliminary approval of the first increment no later than one year from the date of approval of the subject request. Should this condition not be met, the Planning Commission shall reserve the right to initiate action to rezone the subject area to its former designation. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
