ORDINANCE NO. `1
AN ORDINANCE AMENDING SECTION 7.30, THE PAPAIKOU-ONOMEA ZONE MAP,
ORDINANCE NO. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE
COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING THE DISTRICT
CLASSIFICATION FROM SINGLE-FAMILY RESIDENTIAL (RS-20) TO SINGLE-
FAMILY RESIDENTIAL (RS-15) IN KALAOA, SOUTH HILO, HAWAII, COVERED
BY TAX MAP KEY 2-7-31:1, 2, 20, 21, 22 and 23.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.30 of Ordinance No. 63 (Zoning Ordinance),
Revised Ordinances of the County of Hawaii 1967, as amended, is
hereby further amended by adding thereto the following subsection:
"7.30(b). The district classification of the following
area situated at Kalaoa, South Hilo, Hawaii, shall be Single-
Family Residential (RS-15):
Beginning at a pipe at the Northeast corner of this parcel
of land and on the West side of Old Government Road, the
coordinates of said point of beginning referred to Government
Survey Triangulation Station "ALALA" being 14160.87 feet South
and 5410.81 feet East, and running by azimuths measured
clockwise from true South:
1. 3° 00' 377.00 feet along the West side
of Old Government Road
to a pipe;
2. 1° 00' 159.00 feet along the West side
of Old Government Road to
a point in the middle of a
stream;
Thence follow ing along the middle of a stream in all its
windings, the direct a zimuths and distances betwe en points
in the middle of said stream for the next two (2) courses
being:
3. 130° 29' 12" 395.64 feet;
4. 156° 46' 16" 176.59 feet;
5. 234° 46' 99.37 feet along the remainder
of R. P. 5542, L. C. Aw.
8629, Apana 1 to Kaapa
to a pipe;
6. 259° 17' 30" 317.43 feet along the remainder of
R. P. 5542, L. C. Aw. 8629,
Apana 1 to Kaapa to the point
of beginning and containing
an area of 2.734 acres,
"All as outlined in_red on the map attached hereto,
marked Exhibit "A" and by reference made a part hereof."
SECTION 2. Section 1 of this ordinance shall take effect
forthwith upon the conditions that (A) the owner or lessee of the
subject property submit a subdivision plan for preliminary approval
within one (1) year from the date of approval of the change of zone
and (B) the owner or lessee not begin construction of any additional
dwellings until the existing 2" pipeline has been replaced.
SECTION 3. In the event that any portion of this ordinance
is declared invalid, such invalidity shall not affect the other
parts of this ordinance.
SECTION 4.
This ordinance shall take effect upon its approval.
