Home My WebLink AboutORD 1972-512BILL NO. 910 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO. 1512 AN ORDINANCE AMENDING SECTION 7.02, THE NORTH KONA ZONE MAP, ORDINANCE NO. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM UNPLANNED (U) TO AGRICULTURAL (A -la) AT KALAOA 5th, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-3-05:34 AND 7-3-10:PORTION OF 27. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.02 of Ordinance No. 63 (Zoning Ordinance), Revised Ordinances of the County of Hawaii 1967, as amended, by adding thereto the following subsection: "7.02 (z). The district classification of the following area situated at Kalaoa 5th, North Kona, Hawaii, shall be agri- cultural (A -la): Beginning at the northeast corner of this parcel of land and on the west side of Hawaii Belt Road FAP F-10 (5), the coordinates of said point of beginning referred to Government Survey Tri- angulation Station "MOANUTAHEA" being 8116.80 feet south and 8450.00 feet west, thence running by azimuths measured clockwise from true south: 1. 50 09' 121.50 feet along the west side of Hawaii Belt Road; 2. 60 46' 3. 980 12' 48" 4. 3550 41' 5. 960 46' 6. 3370 24' 40" 7. 960 53' 8. 960 25' 9. 1860 25' 10. 3060 32' 10" 11. 1900 00' 12. 2800 00' 76.27 feet along same; 2342.54 feet along the remainder of Grant 2972,- 694.86 972;694.86 feet along same; 51.94 feet along same; 171.10 feet along same; 2495.00 feet along Grant 3821 to Kaulainamoku and Grant 3820 to Loe Kumukahi; 2400.00 feet along Grant 5046; 700.00 feet along the remainder of Grant 2972 to Kaakau and Kama; 315.62 feet along same; 350.00 feet along same; 2100.00 feet along same; along F.P. 1087 and F.P. 10617 13. 3470 49' 391.68 feet along the remainder of Grant 2972 to Kaakau and Kama; 14. 2520 13' 229.13 feet along same; 15. 1670 49' 276.43 feet along same; 16." 2800 00' 86.22 feet along same, along F.P. 1061; 17. 2640 20' 2000.00 feet along same; 18. 2760 50' 1534.20 feet along same; 19. 3470 50' 215.00 feet along the remainder of Grant 2972 to Kaakau and Kama; 20. 2760 50' 792.58 feet along same to the point of beginning and containing an area of 110.079 acres. "All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forth- with upon the conditions that (A) the area be zoned in two (2) incre- ments. The first increment shall consist of fifty-two (52) lots, and the second increment shall consist of the remaining lots. The effective date of zoning for the second increment shall be after development has occurred on the first zoning increment. Development is defined as building permits issued for residential dwelling units and construction partially completed --partially completed in the sense of having roofs on those units on twenty-one (21) or 40% of the lots of the first incre- ment. This is to assure that a minimum of 25% of the lots of the total requested area would have houses on them, and (B) the owner or lessee of the subject area submit a subdivision plan and secure preliminary approval of the first increment no later than one year from the date of approval of the subject request. Should this condition not be met, the Planning Director may act to rezone the land to an appropriate zoning classification. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. - 2- SECTION 4. This ordinance shall take effect upon its approval.
