HomeMy WebLinkAboutORD 1972-513BILL NO_ 911 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO, ~~ +; SAi ORDINANCE AMENDING SECTION 7,02, THE NORTH KONA ZONE MAP, ORDINANCE NO, 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII, 1967, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRI- CULTURAL (A-3a) TO AGRICULTURAL (A-la) IN OOMA 2nd, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-3-07:37, BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1, Section 7,02 of Ordinance No, 63 (Zoning Ordinance), Revised Ordinances of the County of Hawaii 1967, as amended, is hereby further amended by adding thereto the following subsection: "7,02 (y), The district classification of the following area situated at Ooma 2nd, North Kona, Hawaii, shall be agri- cultural (A-la): Beginning at a pipe in concrete at the northeast corner of this parcel of land and on the west side of Hawaii Belt Road, F,A,P, No, F-10(5), the coordinates of said point of beginning referred to Government Survey Triangulation Station "MOANUTAHEA" being 10,183,93 feet south and 8,289,68 feet west, and thence running by azimuths measured clockwise from true south: 1, 347° 13' 126,02 feet along the west side of Hawaii Belt Road, F,A,P, No, F-10(5) to a pipe in concrete; The nce along the west side of the old Government Road for the fol lowing six (6) courses: 2, 5° 45' 32,09 feet to a pipe in concrete; 3, 356° 00' 160,00 feet to a spike in concrete; 4, 341° 30' 146,`20 feet to a pipe in concrete; 46, 279° 51' 214,57 feet along Grant 4343 to J, M, Lilinoe, to the point of beginning and containing an area of 86,50 acres, "All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof," SECTION 2, Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the area be zoned in three (3) increment$ The first increment shall consist of thirty-six (36) lots; the second shall consist of twenty (20) lots; and the third the remaining lots, The effective date of zoning for the second increment shall be after development has occurred on the first increment, Development is defined as building permits issued for residential dwelling units and construction partially completed--partially completed in the sense of having roofs on those units--on nine (9) or 25 per cent of the lots in the first increment, The effective date of zoning for the third increment shall be after development, as defined previously, has occurred on a total of eighteen (18) lots of the previous increment or increments, This is to assure that a minimum of twenty-five (25) per cent of the lots of the entire requested area would have houses constructed on them;
