AN ORDINANCE AMENDING ORDINANCE N0. 38 OF THE REVISED ORDINANCES
OF THE COUNTY OF HAWAII 1967, AS AMENDED, PROVIDING FOR THE REGULA-
TION AND CONTROL OF TAXICAB DRIVERS AND TAXIMETERS, ESTABLISHING
TAXICAB RATES AND FARES, AND PROVIDING PENALTIES FOR THE VIOLATION
THEREOF.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 6 of Ordinance No. 38, Revised Ordinances
of the County of Hawaii 1967, as amended, is hereby further amended
to read as follows:
"(a) Rates of fare within the County of Hawaii. No driver
or owner of a taxicab while operating the same within the County of
Hawaii shall charge, demand, collect or receive a fare other than
that based on the following schedule:
(1) Initial meter actuation. shall equal seventy
cents (70¢) and shall entitle customer to one-sixth (1~6)
of a mile or less, or one minute waiting or elapsed time
or less.
(2) Thereafter, ten cents (10¢) for each additional
one-sixth (1~6) of a mile or fraction thereof.
(3) Ten cents (10¢) for each additional one minute
of waiting or elapsed time or fraction thereof.
Nothing contained in this subsection shall. be construed to permit
charging mileage or waiting time rates of fare which are greater
or less than or different from those established and fixed by the
above schedule. where a ttaximeter is desi-gned to calculate fares
upon the basis of a combination of mileage traveled and time
elapsed, as provided in subsection (b) of Section 5 hereof, the
rates of fare upon such combination of mileage traveled and time
elapsed shall be the same as fixed by t;he above scheduled
(b) No taxicab driver shall charge for waiting time, unless
a passenger directs the taxicab driver to wait.
(c) Whenever, pursuant to a request, it is necessary for a
taxicab to leave its fixed taxi stand to pick up a passenger, the
distance between the fixed taxi stand and the point of pick-up
shall not be added to the distance over which such passenger is
actually transported, when computing the total amount of fare
which may be charged under this section. Nor shall the distance
a taxicab must travel in order to return to its fixed taxi stand
after discharging a passenger be included in the mileage for which
any fare may be charged.
(d) A taxicab driver may charge thirty cents (30¢) for each
piece of baggage, except that small bags such as train cases,
briefcases and packages that are carried into the cab by the
passenger shall be conveyed without charge.
(e) Che aforesaid schedule of rates of fare and baggage charge
shall be posted in a conspicuous place in each taxicab so as t;o be
readily visible to any passenger. Such schedule shall be legibly
printed in bold type letters not less than one fourth. (1~4) of an
inch in height."
SECTION 2. This Ordinance shall take effect upon its
approval; provided however, that the new rates of fare shall not be
charged by individual taxicabs until their taximeter has been
adjusted and has been inspected, tested, and sealed by the Division
of Weights and Measures of the State Department of Agriculture.

This Bill proposes to amend Ordinance No. 38, as amended,
which provides for the regulation and control of taxicab drivers
and taximeters, establishes taxicab rates and fares, and provides
penalties for the violation thereof as follows:
