BILL N0. 917 COUNTY OF HAWAII - STATE OF HAWAII ~y:~ ORDINANCE N0. AN ORDINANCE ESTABLISHING THE NUMBER AND RATES OF COMPENSATION FOR ALL POSITIONS IN DEPARTMENTS, OFFICES AND OTHER AGENCIES OF THE COUNTY OF HAWAII UNDER THE LEGISLATIVE CONTROL OF THE COUNTY COUNCIL, DESIGNATING PAYROLL PERIODS, PAY DAYS, PRESCRIBING CERTAIN REQUIREMENTS WITH RESPECT TO OVERTIl~SE, PERQUISITES AND OFFICIAL FIDELITY BONDS, AND REPEALING ORDINANCE 426, AND ALL AMENDMENTS THERETO; SAID ORDINANCE TO BE KNOWN AS THE SALARY ORDINANCE OF 1972. BE IT ORDAINED BY THE COUNTY COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Declaration of policy. It is the purpose of this ordinance to fix and establish the number and rates of compensation for all positions in departments and offices of the County of Hawaii under the legislative control of the County Council pursuant to the provisions of Section 3-14, County Charter, and chapters 76 a,nd 77 of the Hawaii Revised Statutes. This ordinance also covers other matters relating to compensation of county employees. The term "Employees" as used in this ordinance shall include all officers. SECTION 2. Payroll periods; pay days; fractional computation. All salaries and wages shall be earned and payable in semi-monthly payroll periods, from the first (1st) to the fifteenth (15th) of each month a.nd from the sixteenth (16th) to the end of each month; The fifteenth (15th) day and last day of each month shall be the pay days for all employees; In the case where the required service has been rendered during a full payroll period, one-half (1/2) of the monthly rate shall be paid; When, for any reason, a,ny employee is not entitled to receive the full amount of his semi-monthly installment of salary for any payroll period, the sa.la,ry which he shall receive for such period shall be computed by dividing the semi-monthly installment by the number of days in such period and by multiplying the result thereof by the number of days and/or fraction of days for which pay is due. The Director of Finance shall be authorized to approve payroll claims covering compensation for fractional parts of a month computed otherwise than in accordance with the foregoing requirements, in cases where compliance with such requirements would result in hardship or unfairness to the employees involved. SECTION 3. Overtime. Any employee who is authorized by his department head to perform during any payroll period overtime services in excess of the maximum number of hours set by applicable provisions of the Hawaii Revised Statutes and any act amendatory thereto, or arty rule or regulation passed in pursuance thereof, shall be entitled to compensatory time-off for work in excess of the required maximum number of hours at the rate of one and one-half hours for each hour of overtime work. Overtime shall be granted in terms of compensatory time~ff as mutually agreed to with his appointing authority or in cash payment within forty-five (45) days after the overtime work is performed if the employee does not elect compensatory time credit in lieu of cash payment. SECTION 4. Rate of compensation. When an emergency exists in the opinion of the Mayor, a.nd additional labor or service, not provided for by this ordinance, is needed by the county to care for such emergency, the Mayor is authorized to appoint to a position or employment with the county any such person or persons as he deems necessary at rates within the ranges of compensation prescribed herein, which are comparable to the rates established hereunder in view of the labor or service to be performed, to care for such emergency; provided, however, that no person shall be so appointed unless at the time of appointment of such persons there shall be available legally expendable funds sufficient for his compensation. In the event the Mayor appoints any person or persons to positions or employment under this section he shall report the same to the County Council at its next regular meeting. SECTION ~. Perquisites. That, pursuant to provisions of Section 7~-16, Hawaii Revised Statutes, each department head shall determine, subject to the approval of the Mayor and under such directives as he may issue, the reasonable value of allowance rendered to employees in the form of quarters, heat, light, household equipment, and maid service, laundry service or other perquisites at the expense of the county but not for the convenience or benefit of the county and cause the reasonable value of such allowances to be deducted from the compensation of such employees. The department shall notify the employees concerned of its -10- findings and transmit the same to the Director of Personnel Services and the Director of Finance. SECTION 8. Official Fidelity Bonds. Pursuant to the provisions of Sections 62-~ to 62-9, Hawaii Revised Statutes, and any act amendatory thereto, or any provision passed in pursuance thereto by the County Council, official fidelity bonds, filed and approved in the form and manner set forth in Sections 46-26 and 46-28, Hawaii Revised Statutes, shall be required of the persons appointed to or occupying certain positions enumerated in the above sections; said bonds shall be in the custody of the Director of Finance, excepting the bond of the Treasurer which shall be in the custody of the Mayor, SECTION 9. That the number and rates of compensation for all positions in departments and offices of the County of Hawaii under the legislative control of the County Council of the County of Hawaii be and the same are hereby fixed and established, in accordance with schedules as set forth in Section 4 of this Ordinance, as follows; SECTION 9.01.
