Home My WebLink AboutORD 1972-525BILL NO, 922 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO, `5"7`~ AN ORDINANCE AMENDING SECTION 7,04, THE KAILUA URBAN ZONE MAP, ORDI- NANCE NO, 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE FAMILY RESIDENTIAL (RS-10) TO VILLAGE COMMERCIAL (CV-10) AT LANIHAU 1st, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-5-04:por, 10, BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1, Section 7,04 of Ordinance No, 63 (Zoning Ordinance), Revised Ordinances of the County of Hawaii 1967, as amended, is hereby further amended by adding thereto the fallowing subsectian: "7,04 (g), The district classification of the following area situated at Lanihau 1st, North Kona, Hawaii, shall be village commercial (CV-10): Beginning at the southwest corner of this parcel of land, being also the southwest corner of Parcel 11, easement (15,00 feet wide) for sewer purposes, on the easterly side of Palani Road, the coordinates of said point of beginning referred to Govern- Survey Triangulation Station "ICAILUA" being 159,54 feet north and 439,94 feet west and running by azimuths measured clock- wise from true south: Running along the side of Palani Roy curve to the left radius of 5749,60 chord azimuth and being: easterly ~d on a with a feet, the distance 1, 208° 39' 22,7" 245,43 feet to a nail in rock in concrete on wall; 2, 207° 26' 234,06 feet along the easterly side of Palani Road to a pipe in concrete; 3, 232° 56' 30" 512,37 feet along R, P, 6851, L, C, Aw, 8452, Apana 12 to Keohokalole, Certificate of Boundaries No, 45 to a spike in concrete in pahoehoe; 4, 294° 11' 496,20 feet along remainder of L, C, Aw, 8559-B, Apana 11 to William C, Lunalilo Certificate of Boundaries No, 25 to a pipe in concrete; 5, 57° 36' 146,00 feet along Grant 2035 to J, L, Waiau to a pipe; 6, 45° 56' 507.91 feet along Grant 1861, Apana 2 to Kahiamoe to a "+" on stonewall; 7. 46° 25' 30" 297.29 feet following stonewall along Grant 1861, Apana 2 to Kahiamoe to a spike in concrete; 8, 43° 59" 150,97 feet following stonewall along Grant 1861, Apana 2 to Kahiamoe; 9, 130° 50' 110,94 feet crossing Honokohau-Kailua (Old) Government Road and along the south side of Parcel 11, 15,00 feet wide Sewer Easement; 10, 126° 27' 55" 242,09 feet along the south side of Parcel 11, 15,00 feet wide sewer ease- ment to the point of beginning and containing an area of 10,453 acres, "All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof." SECTION 2, Section 1 of this ordinance s'ha11 take effect forth- with upon the conditions that (A) the proposed commercial complex comply with the Planned Unit Development provisions of Ordinance No. 63, County of Hawaii; (B) the use of dry wells or other acceptable storm- water runoff disposal system be installed by the developer; (C) a minimum of one fire hydrant be installed by the developer fronting Palani Road; and (D) the developer secure a certification from the State Department of Land and Natural Resources, Division of State Parks, that the area has been surveyed for historical sites and arti- facts and that those recommended to be preserved shall be preserved. If no survey has been done, the developer shall be responsible for preparing one and :having it approved by appropriate government agen- cies before any building permit for the subject area shall be issued. Should these conditions not be met, the Planning Commission shall reserve the right to initiate action to rezone the subject area to its former designations. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. - 2 - SECTION 4. This ordinance shall take effect upon its approval.
