AN ORDINANCE AMENDING SECTION 7.02, THE NORTH KONA ZONE MAP, ORDINANCE NO, 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRI- CULTURAL (A-Sa) TO AGRICULTURAL (A-la) AT KEAUHOU 1ST, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-8-04:PORTION OF 73, BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.02 of Ordinance No, 63 (Zoning Ordinance), Revised Ordinances of the County of Hawaii 1967, as amended, is hereby further amended by adding thereto the following subsection: "7.02 (e-e). T'he district classification of the following area situated at Keauhou 1st, North Kona, Hawaii, shall be Agricultural (A-la): Beginning at a pipe in concrete at the southwest corner of this parcel of land, the coordinates of which referred to Government Survey Triangulation Station "KEAUHOU" being 34.91 feet South and 1580,87 feet East, and thence running by azimuths measured clockwise from true South: 1, 1640 30' 243.5 feet along the northeasterly side of Mamalahoa Highway, to a pipe in concrete; 2, 2760 42' 50,2 feet along stone wall, along remainder of R, P, 4475, L, C, Aw. 7713:7 to V, Kamamalu, to a pipe in concrete; 3, 347° 48' 74.6 along stone wall, along R, P, 6391, L, C, Aw, 11047:3 to Poopuu, to a pipe in concrete; Thence along stone wall, along remainder of R, P, 4475, L, C, Aw, 7713:7 to V, Kamamalu, for the following three (3) courses: 4, 265° 12' 119,5 feet to a pipe in concrete; 5. 256° 51' 87.0 feet to a pipe in concrete; 6, 2650 59' 127,2 feet to a pipe in concrete, thence; 7, 354° 06' 140,55 feet alon g rema inder of R, P, 4475, L, C, Aw, 7713:7 to V, Kamamalu, to an iron pin; 8. 810 00' 350.00 feet along Lot 1 of the Keauhou Houselots, along remainder of R, P. 4475, L. C, Aw. 7713:7 to V, Kamamalu to the point of beginning and containing an area of 1.32 acres. "All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part :hereof." SECTION 2. Section 1 of this ordinance shall take effect forth- with upon the condition that the owner or lessee of the subject land be required to submit a subdivision plan and secure tentative approval within one (1) year from the effective date of approval of the change of zone request. Should this condition not be met, action may be taken to rezone the subject area to a more appropriate zoning classi- fication. SECTION 3, In t'he event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This Bill proposes to amend the North Kona Zone Map by changing the district classification from an agricultural (A-Sa) to an agricultural (A-la) zoned district at Keauhou 1st, North Y.ona, I-Iawaii.
