AN ORDINANCE AMENDING SECTION 7,28, THE SOUTH HILO DISTRICT ZONE MAP, ORDINANCE NO. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-l0a) TO AGRICULTURAL (A-Sa) AT KAIEIE HOMESTEADS, KAIEIE, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEY 2-7-5:14. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.28 of Ordinance No. 63 (Zoning Ordinance), Revised Ordinances of the County of Hawaii 1967, as amended, by adding thereto the following subsection: "7.28 (a). The district classification of the following area situated at Kaieie Homesteads, Kaieie, South Hilo, Hawaii, shall be Agricultural (A-5a ): Beginning at the northeast corner of this parcel of land and on the south side of Kaieie Homestead Road, the coordinates of said point of beginning referred to Government Survey Triangulation Station "PAHIHA" being 2048.40 feet North and 1365.30 feet West, and running by azimuths measured clockwise from true South: 1. 3580 23' 1337.15 feet along Lot 3, Kaieie Home- steads, to a point 10 feet from the north edge of Kaieie Stream; thence following along a line 10 feet from and parallel to the north. edge of Kaieie Stream, the direct azimuth. and distance between points 10 feet from the north. edge of said stream being: 2. 950 36' 475.00 feet; 3. 1780 23' 1086.75 feet along Lot 5-B, Kaieie Home- steads, to a point on the south- easterly side of Kaieie Homestead Road; 4. 231° 20' 140.00 feet along the south side of Kaieie Homestead Road; thence along a curve to the right 'having a radius of 539,78 feet, the chord azimuth. and distances being: 5. 2500 43' 30" 358,44 feet along the south side of Kaieie Homestead Road to the point of beginning and containing an area of 13.129 acres. "A11 as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forth- with upon the condition that the owner or lessee of the subject area be responsible for submitting and securing preliminary approval of a subdivision no later than one (1) year from the official date of approval of this rezoning request. Should this condition not be met, action may be taken to rezone the subject area to a more appropriate zoning classification. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
