HomeMy WebLinkAboutORD 1972-537BILL No. 935 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO, ~~~ AN ORDINANCE AMENDING SECTION 7,30, THE PAPAIKOU-ONOMEA ZONE MAP, ORDI- NANCE NO, 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-20a) TO SINGLE FAMILY RESIDENTIAL (RS-7,5) AT WAILUA, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEY 2-6-13:PORTIONS OF 5 AND 7, BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII; SECTION 1, Section 7,30 of Ordinance No, 63 (Zoning Ordinance), Revised Ordinances of the County of Hawaii 1967, as amended, is hereby further amended by adding thereto the following subsections: "7,30 (c-1), The district classification of the following area situated at Wailua, South Hilo, Hawaii, shall be Single Family Residential (RS-7,5): Beginning at the southeast corner of this parcel of land, the coordinates of said point of beginning referred to Government Sur- vey Triangulation St ation "HALAI" being 9502,43 feet North and 3120,99 feet West, a nd running by azimuths measured clockwise from true South: 1, 1170 03' 12" 138,00 feet along Grant 901 to Kaapa; 2, 222° 15' 22,35 feet along the remainder of Grant 1044 to Kamakaimaui and Paakaua; 3, 190° 50' 395.61 feet along the remainder of Grant 1044 to Kamakaimaui and Paakaua to a point on the proposed right-of- way line for the south side of Kaiwiki Road; thence following along the proposed right-of-way line for the south side of Kaiwiki Road on a curve to the left having a radius of 481,00 feet, the chord azimuth and distance being: 4, 266° 26' 27" 107,91 feet; 5, 260° 00' 17,47 feet along the proposed right-of- way line for the south. side of Kaiwiki Road; 6, 100 50' 486,27 feet along the remainder of Grant 1044 to Kamakaimaui and Paakaua to the point of beginning and con- taining an area of 54,455 square feet or 1,2501 acres, "7,30 (c-2), The district classification of the following area situated at Wailua, South Hilo, Hawaii, shall be Single Family Residential (RS-7,5): Beginning at the west corner of this parcel of land and on the northeas terly side of Kaiwiki Road, the coordinates of said point of " begin ning referred to Govern ment Survey Triangulation Station HALM " being 9897,99 feet North. and 2566,89 feet West, and run- nin g by azimuths measu red clockwise from true South: 1, 2100 00' 186,00 feet along Lots 5 and 1, Wainaku Camp 2 Subdivision; 2, 2490 15' 30" 134,32 feet along the remainder of Grant 1044 to Kamakaimaui and Paakaua; thence following along the remain- der of Grant 1044 to Kamakaimaui and Paakaua for the next eight (8) courses: 3, 3170 19' 178,07 feet; 4, 302° 17' 30" 128,08 feet; 5, 335° 03' 55,11 feet; 6, 3500 13' 104,40 feet; 7, 3170 58' 113,97 feet; 8, 3110 00' 109,21 feet; 9, 2930 20' 82,07 feet; 10, 2740 51' 60,13 feet; 11, 2790 49' 249,71 feet along the remainders of Grant 1044 to Kamakaimaui and Paakaua and Grant 1937 to Mary Carney; 12, 110 18' 163,99 feet along the remainder of Grant 1937 to Mary Carney; 13, 316° 50' 87,41 feet along the remainder of Grant 1937 to Mary Carney; 14, 3310 30' 52,58 feet along the remainder of Grant 1937 to Mary Carney; 15, 3420 51' 127,00 feet along the remainder of Grant 1937 to Mary Carney; 16, 34° 40' 32,00 feet along the remainder of Grant 1937 to Mary Carney to a point on the northeasterly side of Kaiwiki Road; - 2 - 17. 124° 40' 202.68 feet along the northeasterly side of Kaiwiki Road; thence following along the northeasterly side of Kaiwiki Road on a curve to the right having a radius of 1160.00 feet, the chord azimuth and dis- tance being: 18. 129° 28' 194,13 feet; 19. 134° 16' 252.71 feet along the northeasterly side of Kaiwiki Road; thence following along the northeasterly side of Kaiwiki Road on a curve to the left having a radius of 987.12 feet, the chord azimuth and distance being: 20. 127° OB' 245.16 feet; 21, 120° 00' 470,74 feet along the 'northeasterly side of Kaiwiki Road to the point of beginning and containing an area of 5.619 acres. "A11 as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof." SECTION 2, Section 1 of this ordinance shall take effect forthwith. upon the conditions that (A) the area be zoned in two (2) increments, The first increment shall consist of twenty-three (23) lots and the second, the remaining lots, The effective date of zoning for the second increment shall be after development has occurred on the first increment, Develop- ment is defined as building permits issued for residential dwelling units and construction partially completed - partially completed in the sense of having roofs on those units - on ten (10) or forty-three (43) per cent of the lots in the first increment, This is to assure that a minimum of twenty-five (25) per cent of the lots of the entire requested area would have residential units on them; (B) the owner or lessee of the subject area submit a subdivision plan and secure preliminary approval of the first increment within one (1) year from the date of approval of the change of zone. Should this condition not be met, action may be taken to rezone the subject area to a more appropriate zoning classification; and (C) the land developer be responsible for improving the frontage road (Kaiwiki - 3 - Road) to County standards fronting the subject area. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance sha11 take effect upon its approval. This Bill proposes to amend the Papaikou-Onomea Zone Map by changing the district classification of land from an agricultural (A-20a) to a single family residential (R5-7.5) zoned district at Wailua, South Hilo, Hawaii.
