ORDINANCE NO. ~-
ORDINANCE ADOPTING THE HAWAII COUNTY CODE.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SEC. 1. ENACTMENT OF HAWAII COUNTY CODE
The Hawaii County Code, consisting of Chapters 1 to 16,
inclusive, and each section thereof, is hereby adopted and
enacted to take effect on approval of this Ordinance. The
Hawaii County Code, containing ordinances of a general and
permanent nature, shall be designated and may be recited as
"Hawaii County Code."
SEC. 2. REPEAL, EXCEPTION
Revised Ordinances of the County of Hawaii 1967, as
amended, is hereby repealed except as herein provided:
A. That all ordinances, amending and effective after
August 3, 1960 and which are omitted from the
Hawaii County Code shall not be deemed to have
been repealed, but shall be continued in full
force and effect unimpaired by the Hawaii County
Code.
B. That the repeal of the Revised Ordinances of the
County of Hawaii 1967, as amended, or any portion
thereof, by this section shall not affect or
impair any act done or right vested or accrued
or any proceeding, suit or prosecution had or
commenced in any cause before such repeal shall
take effect; but every such act done, or right
vested or accrued, or proceeding, suit or
prosecution had or commenced shall remain in full
force and effect to all intents and purposes as
if such Revised Ordinances of the County of
Hawaii 1967, or any part thereof, so repealed had
remained in force. No offense committed and no
liability, penalty or forfeiture either civilly or
criminally incurred prior to the time when any such
Revised Ordinances of the County of Hawaii 1967,
or any part thereof, shall be repealed or altered
by the Hawaii County Code, shall be discharged or
affected by such repeal or alteration; but
prosecutions and suits for such offenses, liabilities,
penalties or forfeitures shall be instituted and
proceeded with in all respects as if such Revised
Ordinances of the County of Hawaii 1967, or any
part thereof, had not been repealed or altered.
C. That no ordinance relating to appropriation of funds,
general plans, improvement districts, salaries of
employees, and moratorium on permit fees and no
resolution relating to improvement districts,
cemeteries, and naming of streets shall be
affected by the repealing clause of this ordinance.
SEC. 3. CONSTRUCTION OF HAWAII COUNTY CODE
Provisions in the Hawaii County Code shall be construed
as continuations or amendments of applicable or corresponding
provisions of previously existing ordinances and not as new
enactments. In case of a conflict between two or more
provisions, or in any case of a latent or patent ambiguity or
obvious clerical error in any provision of the Hawaii County
Code, reference may be had to the previously existing
ordinances for the purposes of applying the rules of construction
relating to repeal by implication or for the purpose of resolving
the ambiguity or correcting the error.
SEC. 4. REVIVOR
When any ordinance repealing a former ordinance, clause,
or provision shall be itself repealed, such repeal shall not
be construed to revive such former ordinance, clause, or
provision.
SEC . 5 . AMENDMENTS
Any additions and amendments to the Hawaii County Code
when passed in such form as to indicate the intention of the
County Council to make the same a part thereof shall be deemed
to be incorporated in such Code so that reference to the "Hawaii
County Code" shall be understood and intended to include such
additions and amendments.
SEC. 6. EFFECTIVE DATE
This Ordinance shall take effect upon its approval.
