AN ORDINANCE RELATING TO THE ESTABLISHING OF REGULATIONS GOVERNING THE INSTALLATION,
CARE, AHD MAINTENANCE OF EIRCTRICAL WORK AND EOUIPMENT IN THE COUNTY OF HAWAII, AND
REPEALING ALL SECTIONS AND PARTS OF SECTIONS OF ORDINANCE OF THE COUNTY OF KAWAII
IN CONFLICT THEREWITH.
SE IT URD,YDED By THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Title ang_humaaa.
A. Title. This Ordinance shall be known as the "Electrical Code," may he
cited as such, and is referred to herein as "this Code."
H. PurE2zt. The purpose of this Code is to reduce the hazards to persons
and property from electrical causes. To accomplish this, the rerguirements set
forth herein are intended to provide a minimum standard for electrical installations
in the County of Hawaii.
SECTICU 2. L.,i' apta.
A. Scope. The provisions ci this Code shall apply to all electrical work
and installations in the Count:', with exceptions as covered By Section 90-2 ( ))
of the 1971 National Electrical Code and the following:
1. Electrical won't,. on buildings or premises owned by or under the direct
control of an agency of the United States.
2. Electrical work By employees of a public utility within the State under
a franchise or charter granted the State whici- is regulated 'py the Pu'elic
Utility Commission, and community antenna television company, while so employed,
pursuant to Section 448E-13, Ilamaii Revised Statutes.
3. The provisions of this Code shall not apply to a Eunicipal System
for street lighting, traffic signal or police and fire alarm where installed
outside of buildings on public property.
4. The physical placement and reassembly of an electric sign, x-ray
eouipment or household appliance.
5. Existing electrical installations which complied with the laws,
ordinances and regulations in effect when the electrical work thereon was
performed, provided that such installations shall Be su :ect to the pro-
,isioes of Su--secto C of hection 4 hereof.
6. Electrical work in accordance with the laws, ordinances and regu-
lations in effect prior to the effective date of this Code under a permit
therefor issued prior to such date.
7. All ' uildings moved into or relocated within the County shall corn-
ply with all rer,uirerlents of this Code for new buildings.
6. Electrical work related to work regulated ' y Chapter 22 of Rule XL of
thC Department of La' or and Industrial Relatio:Is of the State of hawaii, relating
to the Elevator Code, but not including electrical work for the supply of power
to the control panels of elevators, dumb-waiters, escalators, moving walks and
ranTifts.
9. ReplaceLlent or repair of devices and apparatus of air conditioning and
refrigeration systems, except electrical work on overcurrent devices which are
not physically attached to, or physically mounted cn, such systems.
10. The construction, alteration or repair of electrical devices commonly
used in the 'rope such as T.T. sets, radios, tape recorders, movie projectors
and the like.
13. Interpretation - Same aiL'ect Latter. if there are two or mere provisions
in this Code or any other ordinance or statutes, covering the same subject matter,
the provisions which provide the greater safety to life or limb, property or public
welfare shall prevail.
L;ECTIff 3. Definitions. The following words and phrases when used in this
Code shall !-ave the meaning respectively ascribed to them in this section, unless
it is apparent from the context that a different meaning is intended:
A. Administrative fluthoritv. T,Th,.)-iever the term "Administrative Authority" is
used in this Code, it shall be construed to mean the Chief Engineer of Hawaii County
Department of Public Works or his authorized representative.
B. Assistants. Whenever the term "assistants" is used in this Code, it shall
he construed to mean tie authorized representatives of tl-e, Administrative Authority.
C. ,)elearti.lent. The Department of Public ',jerks of the Conisty of Hawaii.
D. Electrical Contractor and Electrical Specialt:- Contractor. Any person who
is licensed under provisions of Chapter 444, Hawaii T),eyised 2tatutcs, and possess a
valid, unexpired and unreyokkA license nualifyin- bin c perform electrical or elec-
trical specialty work.
E. Electrical Work. The installation, alteration, reconstruction, or repair of
electrical wiring.
F. Electrical Wirinc-. Any conductor, material, device, fitting, apparatus,
appliance, fixture or e,luipment, constituting a part of or connected to any electrical
installation, attached or fastened to any building, structure or premises and which
installation or portion thereof is designed, intended or used to generate. transmit,
transform or utilize electrical energy within the scope and purpose of the National
Eectrical oede referred in ir Section 16 of this Cede-

:card of Electriciars and Plumbers as a journeyman specialty electrician under the
provisions or Chapter 44,n', Hawaii Revised Statutes.

Maintenance Work. '11-e keeping in repair and operation of any electrical
installation, apparatus, fixtures:, appliance or

K. Motion Picture Operator. Any person who has 'seen licensed by the Board of
Electricians and Plum'-erg as a motion picture operator under the provisions of
Chapter 40E, Hawaii Revised Statutes.
L. alz/21§inaILIELEician. Any person who has teen licensed by the Board of
Electricians and Plumbers as a supervisin-, electrician under the provisions of
Chapter 445E, Hawaii Revised Statutes.
E. LLELIIILLILLILaaialy Electrician. Any person who has been licensed by the
Hoard of Electricians and Plumbers as a supervising specialty electrician under the
provisions of Chapter 448E, Hawaii Revised Statutes.
SECTION 4. Administration and Enforcement.
A. Department j-ivin7 Jurisdiction. Unless otherwise provided for by law, the
Department of Public Jorks of the County shall have jurisdiction over and administer
all matters covered by this Code.
B. Lizit21LlaLa. Whenever necessary to make an inspection to enforce any of
the provisions of this Code, or whenever the Administrative Authority or his Assistant
has reasonable cause to believe that there exists in any ' uildin7, structure or pre-
mises hazards to persons and property from electrical causes, the Administrative Autho-
rity or his Assistant maz enter such Buildrig, structure or premises at all reasonable
times to inspect the same or to perform any duty imposed upon the Administrative Autho-
rit:, "--y the Code; provided, that if such huiTdin,, structure or premises are unoccupied,
Le shall first make a reasonable effort to locate the owner or other persons having
charge or control of the "euildin,, structure or premises and demand entry. If such
entry is refused, the Administrative Authority or his Assistant shall have recourse
to every remedy provided by law to secure entry.
C. ILLTt21LIaad Procedures.
1. All electrical wiring, for which a permit is recuired, shall be inspected
and approved by the Administrative Authority before being concealed, energized or
used. 511 fees recuired bb the Code shall be paid by the permittee prior to the
ener,izing or use of such wirin-.
2. No persor shall use, operate or maintain, or cause or permit to be used,
operated or maintained, any electric wiring until it is inspected and approved.
3. No serving agency shall supply, or cause or permit to be supplied, elec-
tric energy to any electric wiring until the wiring has been inspected and
approved.
EXCEPTIO . Temporary construction services installed by the serving agency for
temporary use, as prescribed under this Code and to he used during
construction only.
4. No person shall conceal, enclose or cover, or cause or permit to he con-
cealed, enclosed or covered, any portion of an3, electric wiring or er'uipment in
any manner which will interfere with or prevent the inspection and approval thereof.
5. Fixtures, appliances, devices or eouipment shall not be connected to anz,
electric wiring until the rough electric wiring, including conductors have been
inspected and approved, except as otherwise satisfactory to the department.
6. All obstructions, covers, plates, tapes, etc., which makes impracticable
the making of a thorough inspection of electric wiring shall be removed upon
notice (either verbal or in writin7) to do so, and shall be kept removed until
the electric wiring has -een inspected and approved.
D. Defective Electrical Installations. Whenever any electrical installation is
found to have been installed, altered, changed or reconstructed contrary to the pro-
visions of this Code or any other law, whenever any electrical installation is found
to be in use contrary to the provisions of this Code or any other law, or whenever any

electrical installation, Which complied with the existing laws, ordinances and
regulations in effect when the electricalwork thereon was performed, is found
to be unsafe or dangerous to persons or property, the Administrative Authority shall
give the owner or the person in control of such installation a written notice stating
the findings with respect to such installation and order the owner or such other
person to make the corrections to be set forth in such written notice.
E. Re-cues-b fpr Inspection. Whenever any work regulated by this Code, or any.
portion thereof, is ready for inspection, the Ps3m.Lnistrative Authority shall be
notified by the person that same is ready' for inspection. The notice shall be in
writing on forms furnished by the Administrative Authorit -, or may be by telephone
at the option of the A7taissistrative Authority. The notice shall be filed with the
Department not less than 4,8 hours and net more than 72 hours 'before any such inspec-
tion is desired.
1. The Administrative Authority shall proceed to inspect the same within
0 hours, not including Sundays or holidays, after receipt of suchnotice, and
if said work conforms in all respects with the provisions of this Code, he shall
attach a notice granting authority to proceed with installations.
i. No electrical wiring shall be covered or concealed until the said 4.8
hours have expired after notice to the Administrative Authority has been received
in his department, or until the Administrative Authority has approved the installa-
tion and given permission to cover or conceal the same. Should the Administrative
Authority condemn any of said work or equipment as not being in accordance with.
the provisions of this Code, notice in writing to that effect shall be given by
him to the person enr7a7ed in the work.

altered or removed as the case may require, and necessary changes shall be made
so that all such work and equipment may fully comply with the provisions of this
Code before further work is connected on or with such condemned work or equipment.
In default, said Contractor shall be liable to the penalties provided in this
Code, and any and every owner, contractor or other person engaged in construction
of the building or structure, or otherwise, covering or allowing to be covered
such portion of work or equipment, or removing any notice net to cover same
placed thereon by tire Administrative Authority shall likewise be liable to the
penalties in this Code provided.
F. Final inspection Required.
1. No person shall use or supply electrical energy to any electrical
installation on which electrical work was or is being performed under a permit
issued pursuant to the provisions of this Code before the Administrative Authority
has approved such installation.
2. 7ilhenever electric wiring has 'eeen approved, a certificate of inspection
therefor shall be issued on demand, provided all fees required by this Code have
been paid.
G. ResponsiLLILLLELapliance. Every person. installing, altering, repairing,
using or maintaining electric wiring shall be responsible for compliance with this Code.
H. LiabilityofPersons. This Code shall not be construed to relieve from or
essen the responsibility of such person owning, operating or installing any electri-
cal wires, appliances, apparatus, construction. or equipment for damages to any one
injured by anydefect therein.
I. Non=ma2aaLLILLIL2122uaLL. Neither the County of Hawaii, nor any. department,
card, commission, officer, employee, or the Administrative Authority thereof shall be

held liable or responsible for any damage or injury caused by or resulting from the
issuance of any permit issued, or any inspection or approval or issuance of a
certificate of inspection, made under the provisions of this Code.
SECTION 5. Permits Reouired: Exceptions.
A. Permit Required and Exceptions. No person shall perform any electrical
work or cause or permit the same to be done, unless a permit therefor has been
obtained from the Administrative Authority with the following exceptions:
1. Electric work and installations to which the provisions of this Code
are expressly declared to be not applicable.
2. Installation of any portable motor or other portable appliance energized
by means of a cord or cable having an attachment plug and, if such cord or cable
is permitted by this Code.
3. Repair of any fixed motor or other appliance, or replacement of any
fixed motor with another having the same horsepower rating and situated at the
same location.
4. Replacement of attachment plug receptacles, but not the outlet therefor.
5. Maintenance work by a properly licensed electrician.
6. Emergency electrical work by a person to whom a permit may be issued.
7. Electronic equipment, sound public address systems and communication
systems for a single-family or two-family dwelling.
8. Radio and television receiving antenna systems other than master or
community systems in or about commercial and industrial buildings, including
hotels, multiple family dwellings,and apartment houses.
9. Sound recording systems for a single-family or two-family dwelling.
10. The provisions of the foregoing exceptions shall not apply to any
repairs or replacements of electrical devices, apparatus, or appliances which
were originally installed without a permit when such permit is required for the
original installation, or when energized by, or which is a part of any hazardous
or illegal wiring system.
11. The foregoing exceptions from permit requirements shall not be deemed to
allow any electric wiring to be done in a manner contrary to other provisions of
this Code.
B. Scope of Permit.
1. The issuance of a permit is not an approval or an authorization of
work specified therein. A permit is merely an application for inspection, the
issuance of which entitled the permittee to inspection of the work which is
prescribed therein.
2. Neither the issuance of a permit nor the approval by the Administrative
Authority of any document shall constitute an approval of any violation of any
provision of this Code or of any other law or ordinance, and a permit or other
document purporting to give authority to violate any law shall not be valid with
respect thereto.
C. Emergency Work. When emergency electrical work is commenced without a permit,
an application for a permit for the work shall be made pursuant to the provisions of

Section 7 hereof on the first working day immediately following the day work is
commenceth

or structure, except that a permit for a main building oiay include elec—
trical work for a private garage, shed, or accessory building located. on the same
premises as the main building, and supplied by a feeder or circuit from the main.

LECTICL 7. AalLaaLialliarLlaiL.
A. Filing. To obtain a permit, the applicant shall file an application on
forms furnished by the Administrative Authority. The applicationshall contain all
information necessary to the lawful enforcement of ti.(73 provisions of this Code.
b. Plans and .SPecifications. The applicationshall be accompanied by approved.
plans and specifications or a suitable diagram when and as required by Section C.
C. Issuance of Permit. When the .AdminiFive Authority determines that the
information on the application and plans is i conformance with.. this Code, the
Administrative Authority shall issue a permit upon receipt of the tota2 fees.
D. Exceptions. Nothing contained in this Code shall be construed to require
the Administrative Authority to immediately accept or re.lect any application, wher—
ever it is necessary to investigate the proposed wino and premises as to its
compliance with this Code, or it is necessary to check plans and specifications
accompanyin7 the application,

details of the proposed installation as may be required by the Administrative Authority
shall be filed wit1. the application. Such plans and specifications shall bear the
approval of either a professional engineer registered in the State of Hawaii as
especially qualified in the electrical.. branch of engineering, or a professional
architect cr other engineer registered. in the State of Hawaii and qualified in auch
work by experience, provided that if to demand load of the proposed installation
is less than thirt:: (30) kilo—volt—ampers, this reQuirement shall be applicaLle only
if the Administrative Authority so directs.
No person shall materially deviate from. anT approved plan or specifications
or fail, neglect or refuse to comply therewith, unless permission to do so has first
seen o' bal_ned. from the Departent.
SECTION Q. Issuance. If the Administrative Authority is satisfied that the
installation described in the applicationwill conform to the provisions of this
Code and all pertinent laws, =A tie fee prescri7Ted in Section 14 hereof has been
paid, he nay issue a permit to th.7 parsers specified in Section 10 hereof.
SECTION 10. Persons to Ul= Permits haybe Issued. A permit maybe issued only

B. Compliance Re-uired. No person shall do or cause to be done any electrical
work which does not comply with the provisions of this Code.
SECTION 17. Standards of Performance of Electrical W . No person shall
perform any work covered by this Code in violation of the provisions of Chapter
44CE, Hawaii Revised Statutes.
SECTION 18. Qualification of Performance of Work Under the Electrical Code
A. Compliance with
.. . .tmaiiRevised Statutes: It shall be unlawful for any
permittee to perform or allow to be performed any work covered by the permit issued
under this Code in violation of Chapter 444, Hawaii Revised Statutes, relating to
the licensing of contractors, and Chapter 448E, Hawaii Revised Statutes, relating
to the licensing of electricians and plumbers.
B. Any person engaged in a business involving performance of electrical work
covered by this Code, shall maintain a place of business in a business or industrial
zone in accordance to the provisions of Zoning Ordinance No. 63 of the County of
Hawaii, with a listed telephone number and be principally engaged in said business
during the normal business hours for said place of business.
SECTION 19. apttalz_alci_auLi2az. Any appeal from the decision of the Adminis-
trative Authority in the administration of the County of Hawaii Electrical Code
involving any denial of the use of new or alternate materials, types of construction,
erluipment, fixtures, devices or appliances, or any petition for varying the applica-
tion of the Electrical Code may be submitted to the Board of Appeals for hearing
and determination as specified in Section 204, Uniform Building Code, as amended,
under Section 6, Ordinance 501 of the Revised Ordinance of the County of Hawaii
1967, as amended.
SECTION 20. Penalty. Any person, firm or corporation violating, or failing
to comply with any of the provisions of this Code, shall upon conviction thereto be
punished by a fine not exceeding Five ,iundred Dollars ($500.00) . Each separate
day or any portion thereof during which any violation of this Code occurs or continues
shall 're deemed to constitute a separate offense, and upon conviction thereof shall
be punishable as herein provided.
SECTION 21. Offenses Under Former Ordinances Saved. Nothing contained in any
provision of this ordinance shall apply to an act done or omitted, or to an offense
committed at any time before the enactment of this ordinance. Such act or omission
shall be governed by, and any such offense shall be punished according to the pro-
visions of the ordinances existing when such act, omission or offense, occurred in
the same manner as if this ordinance had not been enacted.
SECTION 22. Repeal of Prior Ordinance, Preservation of Rights and Liabilities,
Construction of Revised Ordinance.

repealed.

act done, ratified Or confined, or any right accruing or accrued or established,
or any action, suit or proceeding had or commenced in any civil cause, prior to said
repeal, but all rights and liabilities under any ordinance embraced in the said
ordinance or so repealed shall continue, and may be enforced in the same manner and
with the same effect as if said repeal had not been made.
C. Construction of Revised Ordinances. Provisions in said ordinance shall be
construed as continuations or amendments of applicable or corresponding provisions
of previously existing laws and not as new enactments. In case of a conflict between
said and other ordinances, or in case of latent and patent ambiguity or obvious

clerical error in said ordinance, reference may be made to the previously existing
ordinances for the purpose of applying the rules of construction relating to repeal
by implication or for the purpose of resolving the ambiguity or correcting the error.
SECTION 23. Ordinance No. 59, Revised Ordinances of the County of Hawaii 1967,
as amended, is hereby repealed.
SECTION 24. This ordinance shall take effect upon its approval.
