ORDINANCE NO .^ `~r~~l
AN ORDINANCE RELATING TO THE CONSTRUCTION AND MAINTENANCE
OF SIDEWALKS IN THE COUNTY OF HAWAII, STATE OF HAWAII, AND
REPEALING ORDINANCE N0. 54, REVISED ORDINANCES OF THE COUNTY
OF HAWAII 1967.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Curbing and Gutter. That every owner of
land abutting on or adjoining any public highway or street
in the County of Hawaii, State of Hawaii, upon being required
by the Council of the County of Hawaii, and being notified of
such requirement, as herein provided, shall construct and
maintain good condition the curb and/or gutter along the
sidewalk area adjacent to such land, on the established lines,
with substantial curbing of concrete, which shall conform to
the following specifications:
Specifications
a. Concrete Curbing and Gutter. Concrete curb shall be
of the dimensions specified in Detail Nos. P-1005 and P-1006 of
the Standard Details of the Department of Public Works, County
of Hawaii, dated October, 1969, as amended.
Materials and construction shall be governed by the
applicable subsections of Section 609 - Curb and/or Gutter of
of the Standard Specifications for Road and Bridge Construction
of the Highways Division, Department of Transportation, State
of Hawaii, dated 1969, as amended.
At street intersection of two different sidewalk widths
the curbing radius shall be that of the greater sidewalk
width.
The County of Hawaii may require the property line at
the intersection to be a rounded one instead of angled. The
required radius shall be set by the Department of Public
Works.
Sidewalk
SECTION 2. Sidewalk. That every owner of land abutting
on or adjoining any public highway or street in the County of
Hawaii upon being required by the Council of the County of
Hawaii and being notified of such requirement, as herein
provided, shall construct and maintain in good condition the
sidewalk within the established sidewalk area on the highway
or street adjacent to such property to conform to the following
specifications.
Specifications
a. Concrete Sidewalk. The sidewalk area shall be of the
width called for in Detail No. P-1003 of the Standard Details
of the Department of Public Works, County of Hawaii, dated
October, 1969, as amended. The width of the concrete slab
may be varied to provide for grass or planting strip in
accordance to design scheme proposed and approved by the
Department of Public Works and the Planning Department, County
of Hawaii.

Materials and construction shall be governed by the
applicable subsections of Section 608 - Sidewalks of the
Standard Specifications for Road and Bridge Construction of
the Highways Division, Department of Transportation, State
of Hawaii, dated 1969, as amended.
b. Drop Driveway. The drop driveway across the sidewalk
area shall be of the dimensions and detail specified in Detail
No. P-1007 of the Standard Details of the Department of Public
Works, County of Hawaii, dated October 1969, as amended.
Material and construction shall be governed by the
applicable subsections of Section 610 - Reinforced Concrete
Driveways of the Standard Specifications for Road and Bridge
Construction of the Highways Division, Department of Transportation,
State of Hawaii, dated 1969, as amended.
SECTION 3. Appurtenant Works.
a. Drainage. When required by the construction inspector
and/or engineer approved drainage system shall be installed.
b. Retaining Walls. In all cases where retaining walls
are structurally determined necessary to contain the sidewalk
fill or property cut section appropriate retaining structure
approved by the Department of Public Works, County of Hawaii,
shall be constructed.
c. Walks Laid Over Substructure Openings. Where the
curb and sidewalk cross a substructure opening the crossing

shall be structurally designed by a registered professional
engineer to adequately carry the dead load plus the live load
the crossing is proposed to carry.
SECTION 4. Whenever the Council of the County of Hawaii
shall deem it proper or necessary that any sidewalk or sidewalks
shall be curbed or curbed and constructed as hereinbefore provided,
it shall, by resolution, designate a location or area of sidewalk
construction which location or area shall not be less in extent
than one side of a street or highway between two intersecting
cross streets. The resolution shall also contain a provision
requiring the owner or owners of the land abutting on and
adjoining any public street or highway along which said sidewalk
is to be so constructed within such location or area, to curb
or curb and construct, the same as provided herein, and the
said Council of the County of Hawaii, after so requiring the
owner or owners of any land abutting on and adjoining any public
street or highway to lay any curbing, or to curb and construct
any sidewalk as required herein and as provided by Sections
265-26 to 31, Hawaii Revised Statutes, shall cause a written
notice to be given such owner or owners or his or their duly
authorized agent or agents of such requirement such notice to
be substantially in the following form:

TO
You are hereby notified that at a meeting of the Council
of the County of Hawaii, State of Hawaii, duly held on the
day of A.D. 19 a resolution was
adopted by the said Council that you be required to curb and
construct and maintain a sidewalk upon the established lines
abutting on and adjoining your property on
Street, between
Streets, in the County of Hawaii, State of Hawaii, in accordance
with the provisions of Sections 265-26 to 31, Hawaii Revised
Statutes, and the Ordinances of the County of Hawaii.
You are further notified that if you fail to comply with
such direction for sixty (60) days after this notice, the County
of Hawaii will proceed to construct such sidewalk at your expense
as provided by law.

SECTION 5. Care of Sidewalks. All owners of lands abutting
on and adjoining any public streets after curbing has been laid,
shall, at their own expense, keep their sidewalks clean and free

of all weeds, noxious growths or other vegetable matter;
provided, however, should the owners have grass grown thereon
they shall keep same cut so same shall not be a nuisance or
inconvenience to the public passing thereon.
Any person, firm or corporation who shall be convicted
of violating any of the provisions of this Section shall be
fined not more than One Hundred Dollars ($100.00).
SECTION 6. Ordinance No. 54, Revised Ordinances of the
County of Hawaii 1967, is repealed.
SECTION 7. This Ordinance shall take effect upon its
approval.
