SECTIO\ 1 Emereenc~ Ordinance Thts is an emergency' ordinance necessitated by the
damaees incurred by the people of the County of Ha~tai'i due to the tloodmg occurnne on
\o~ember 1 ~ 2, _'000 As a result of said flooding, many structures and buildings Mere
damaged This ordinance recognizes that there is a pressing need to make repairs and to
reconstruct bwldings and structures so damaged as a result of the tloodmg To impose all of the
requirements of Chapters d. 9. l7, 22 and 2~ of the Hataai ~ County Code (as amended), ttiill
impose unnecessary and umvarranted hardships upon the people of the County of Hawaii
This ordinance is adopted pursuant to Section 3-1 1, Counn• Chaner, County of Hawaii,
m order to diminish the difficulties and hardshtps which would result from insistence upon stnct
compliance with Chapters 3, 9, 17. 22 and of the Hawaii County Code (as amended)
SECTION 2 Purpose To afford am person. partnership, or corporation in the County
of Hawat't that was affected by the November 1 & 2. 2000 tloodmg the opportunin• to repair
siens. dnveway approaches, sidewalks and other pnvate improvements and to rebuild damaged
structures and bwldings wrthout having to stnctly comply with all requtrements of Chapters 3,

SECTION 3 Apphcabilrty This ordinance shall be applicable only to [hose persons,
partnerships and corporations, which buildings or structures ~+ere directly affected b~ the
November 1 & 2. 2000 flooding
SECTION d The Mayor of the County of Hawaii. through his designated
representatives, shall have the power to waive certain requtrements of Chapters 3, 9, 17, 22
and 2~ of the Hawa['[ County Code (as amended), including but nut limned to permit fee.

SECTION ~ Vo w~arver granted shall be used to construct a nonconforming bwldmg,
prov[ded however that [f a bwldmg or structure was nonconforming with respect to ordinance
regwrements pnor to November 1 & 2, 2000. the !~9ayor shall have the power to wave ordinance
requ[rements with respect to those bu[]dmgs [f doing so does not enlarge the extent to which such
buildings are to nonconformance w~tth Chapters 3. 9. 17, 22 and 2~ of the Hawa['[ Count
Code (as amended)
SECTION 6 Revocat[on of Waivers All wavers [ssued pursuant to th[s ordinance shall
be subject to revocauon at any t[me for noncompl[ance with the condmons and safeguards
attached thereto, or for noncompliance with th[s ordinance
SECTION 7 Appeal .4m action taken by the Mayor pursuant to [h[s ordinance may be
appealed to the County Council
SECTION 8 Durat[on The h1ayor shall cease to [ssue anv waiters pursuant to this
ordinance si~t~ (60) days after the effective date of flits ordinance
SECTION 9 Th[s ordinance shall take effect upon [ts approval
