Home My WebLink AboutORD 1973-571BILL No. 973 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE N0. ~r7~-~~ AN ORDINANCE AMENDING SECTION 7.06, THE NORTH AND SOUTH KOHALA DISTRICT ZONE MAP, ORDINANCE NO. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-20a) TO AGRICULTURAL (A-3a) AT KAAUHUHU HOMESTEADS, KAAUHUHU, NORTH KOHALA, HAWAII, COVERED BY TAX MAP KEY 5-5-01:22 (PORTION), 41 AND 69. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.06 of Ordinance No. 63 (Zoning Ordinance), Revised Ordinances of the County of Hawaii 1967, as amended, is hereby further amended by adding thereto the following subsection: "7.06(j). The district classification of the following area situated at Kaauhuhu Homesteads, Kaauhuhu, North Kohala, Hawaii, shall be agricultural (A-3a): Beginning at the west corner of this parcel of land, being also the north corner of Grant 9126 to Augusta Isaacs, on the southeasterly side of Kohala-Waimea Road (Old Main Government Road), the coordi- nates of which referred to Government Survey Triangulation Station "PUU O NALE" being 2,503.30 feet North and 2,785.20 feet East and running by azimuths measured clockwise from true South: 1. 251° 50' 95.00 feet along the southeasterly side of Kohala-Waimea Road (Old Main Govern- ment Road); 2. 229° 40' 130.00 feet along the southeasterly side of K o hala-Waimea Road (Old Main Govern- or e nt Road) ; 3. 213° 90' 100.00 feet along the southeasterly side of Kohala-Waimea Road (Old Main Govern- ment Road); 4. 194° 00' 68.03 feet along the southeasterly side of Kohala-Waimea Road (Old Main Govern- ment Road); 5. 234° 40' 274.49 feet along the southeasterly side of New Main Government Road; 6. 258° 50' 48.69 feet along the southeasterly side of Kohala-Waimea Road (Old Main Govern- ment Road); 7. 274° 00' 92.90 feet along the southeasterly side of Kohala-Waimea Road (Old Main Govern- ment Road); 8. 222° 40' 210.00 feet along the southeasterly side of Kohala-Waimea Road (Old Main Govern- ment Road); g, 262° 11' 297.00 feet along the southeasterly side of Kohala-Waimea Road (Old Main Govern- ment Road); 10. 255° 00' 65.00 feet along the southeasterly side of Kohala-Waimea Road (Old Main Govern- ment Road); 11. 178° 00' 193.27 feet along the southeasterly side of Kohala-Waimea Road (Old Main Govern- ment Road); thence along the southeasterly side of New Main Government Road, on a curve to the right with a radius of 3,769.72 feet, the chord azimuth and distance being: 12. 241° 52' 30" 106.44 feet; 13. 319° 03' 1,081.68 feet along Lot 21 of Land Court Appli- cation 1122; 14. 49° 40' 525.10 feet along Grant 9127 to Rose Martins and Grant 5-14736; 15. 48° 58' 991.00 feet along Grant 5-14736 and Grant 6234 to Daniel Kaaeamoku Keohokapu; 16. 140° 11' 858.40 feet along Grant 9126 to Augusta Isaacs; 17. 140° 13' 349.60 feet along Grant 9126 to Augusta Isaacs to the point of beginning and containing a gross area of 39.17 acres and a net area of 37.27 acres after excluding and deducting Exclu- sions 1 and 2 (as shown on Map 3 of Land Court Application 1122). "All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the owner or lessee of the subject area be responsible for securing preliminary approval of a subdivision plan within one year from the date of approval of the change of zone; and (B) a mini- mum of four lots be developed with residential structures or under agri- cultural cultivation on a minimum of two acres within three (3) years from the date of approval of this request. Should this condition not be met, action may be taken to nullify any subdivision approval and to reclassify the subject area to a more appropriate designation. - 2 - SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4 This ordinance shall take effect upon its approval.
