AN ORDINANCE AMENDING SECTION 7.06, THE NORTH ZONE MAP, ORDINANCE N0. 63 (ZONING ORDINANCE), COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING TION FROM AGRICULTURAL (A-20a) TO AGRICULTURAL STEADS, SECOND SERIES, KAAUHUHU, P10RTH KOHALA, MAP KEY 5-5-13:17 AND 18. AND SOUTH KOHALA DISTRICT REVISED ORDINANCES OF THE THE DISTRICT CLASSIFICA- (A-la) AT KAAUHUHU HOME- HAWAII, COVERED BY TAX BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.06 of Ordinance No. 63 (Zoning Ordinance), Revised Ordinances of the County of Hawaii 1967, as amended, is hereby further amended by adding thereto the following subsection: "7.06(i). The district classification of the following area situated at Kaauhuhu Homesteads, Second Series, Kaauhuhu, North Kohala, Hawaii, shall be Agricultural (A-la): Beginning at the northwest corner of this lot and also on the south boundary of a road easement, the coordinates of said point of begin- ning referred to Government Survey Triangulation Station "PUU 0 NALE" being 16,709.54 feet North and 4,286.61 feet East, thence run- ning by azimuths measured clockwise from true South: 1. 270° 00' 300.00 feet along the south boundary of a road easement; 2. 180° 00' 50.00 feet along road easement; 3. 270° 00' 140.00 feet along road easement; Thence along a curve to the left with a radius of 535.00 feet, the chord azimuth and distance being: 4. 263° 22' 25.6" 124.10 feet along road easement; 5. 6° 35' 485.98 feet along the west boundary of Hawi Road; 6. 90° 00' 507.51 feet along the north boundary of Lot 81 of Grant 8650 to Chong Hing Tenn; 7. 0 180 00' 418.49 feet along the east boundary of Lots 14 and 15 of a portion of Lot Number 82 of Kaauhuhu Homesteads Lots, Second Series, to the point of beginning and containing an area of 5.418 acres, or thereabouts. "All as crosshatched on the map attached hereto marked Exhibit "A" and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the lowner or lessee of the subject area be responsible for securing preliminary approval of a subdivision plan within one (1) year from the date of approval of the change of zone; and (B) a minimum of two (2) dwellings be under construction within three (3) years of the date of approval of this request. Should this condition not be met, action may be taken to nullify any subdivision approval and to reclassify the subject area to a more appropriate designation. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
