BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.02 of Ordinance No. 63 (Zoning Ordinance), Revised Ordinances of the County of Hawaii 1967, as amended, is hereby further amended by adding thereto the following subsection: "7.02(ff). The district classification of the following area situated at Kaloko, North Kona, Hawaii, shall be Agricultural (A-la): Beginning at a point at the northwest corner of this parcel of land, and on the easterly side of Mamalahoa Highway, the coordinates of said point of beginning referred to Government Survey Triangulation Station "MOANUTAHEA" being 15,815.62 feet South and 7,483.05 feet West, thence running by azimuths measured clockwise from true South: 1. 259° 30` 50" 498.58 feet along Lot 2B(1), along the remain- der of R. P. 8214, L. C. Aw. 7715, Apana 11 to Lota Kamehameha; 2. 345° 06' 350.76 feet along Lot 2A, along the remainder of R. P. 8214, L. C. Aw. 7715, Apana 11 to Lota Kamehameha, to a pipe in con- crete; 3. 79° 30' S0" 837.60 feet along 40 foot Road Reserve and Lot 2D(1), along the remainder of R. P. 8214, L. C. Aw. 7715, Apana 11 to Lota Kamehameha to a pipe in concrete; 4. 222° 37' 30" 40.09 feet along stone wall, along the easterly side of Mamalahoa Highway to a pipe in concrete; 5. 238° 54' 48.91 feet along stone wall, along the easterly side of Mamalahoa Highway to a pipe in concrete; 6. 240° 30` 30" 62.85 feet along stone wall, along the easterly side of Mamalahoa Highway to a pipe in concrete; 7. 218° 29' 46.69 feet along stone wall, along the easterly side of Mamalahoa Highway to a pipe in concrete; 8. 206° 14' 30" 205.92 feet along stone wall, along the easterly side of Mamalahoa Highway to a pipe in concrete; 9. 197° 44' 40.81 feet along stone wall, along the easterly side of Mamalahoa Highway to a pipe in concrete; 10. 171° 49' 30" 43.82 feet along stone wall, along the easterly side of Mamalahoa Highway to a pipe in concrete; 11. 149° 11' 30" 13.31 feet along stone wall, along the easterly side of Mamalahoa Highway to the point of beginning and containing an area of 4.880 Acres. "All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the owner or lessee of the subject area be responsible for submittal of a subdivision plan substantially as presented and for securing tentative approval within one (1) year from the date of approval of the change of zone; (B) the owner or lessee be responsible for the construction of one (1) dwelling within three (3) years of the date of approval of the change of zone; and CC) that all necessary improve- menu , i.e. water, roads etc., required at the time of subdivision be provided. Should these conditions not be met, action may be taken to nullify any subdivision approval and to reclassify the subject area to a more appropriate designation. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4 This ordinance shall take effect upon its approval.
