AN ORDINANCE Ar"iENDING SECTION 7.12, THE HAMAKUA DISTRICT HOMESTEADS AREA
ZONE MAP, ORDINANCE IVO. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF 'PHE
COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION
FROM AGRICULTURAL (A-Sa) TO AGRICULTURAL (A-la) AT KAAO HOMESTEADS, HAMAKUA,
HAWAII, COVERED BY TAX MAP KEY 4-5-03:PORTION OF 14.
BE IT ORDAINED BY THE COUNCIL OF THE COUIQTY OF HAWAII:
SECTION 1. Section 7.12 of Ordinance No. 63 (Zoning Ordinance)
Revised Ordinances of the County of Hawaii 1967, as arnended, is hereby
further amended by adding thereto the following subsection:
"7.12(b). The district classification of the following area
situated at Kaao Homesteads, Hamakua, Hawaii, shall be Agricultural
(A-la):
Beginning at the north corner of this parcel of land and at the inter-
section of two Homestead Roads, the coordinates of said point of
beginning referred to Government Survey Triangulation Station "KAAO"
being 3428 .80 feet South and 476 .10 feet West, and running by azimuths
measured c lockwise from true Sou th:
1. 322° 36' 473.00 feet along the southwest side of a
Homestead Road;
2. 51° SS' 245.00 feet along the northwest bank of
gulch;
3. 31° 30' 143.78 feet along the northwest bank of
gulch;
4. 155° 06' SO" 368.77 feet along the rernainder of Gr ant
9732;
5. 203° 20' 343.00 feet along the southeast side of a
Homestead Road to the point of begin-
ning and containing an area of 3.00
acres.
All as outlined in red on the map attached hereto, marked
Exhibit "A" and by reference made a part hereof."
SECTION 2. Section 1 of this ordinance shall take effer_t forthwith
upon the conditions that (A) the owner or lessee of the subjer_t area sub-
mit a subdivision plan for preliminary approval within one (1) year from
the date of approval of the subject request; and (B) one (l) dwelling be
constructed on one of the lots within three (3) years. Should these condi-
tions not be met, action may be taken to nullify any subdivision approval
and to reclassify the subject area to a more appropriate designation.
SECTION 3. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts of this
ordinance.
SECTION 4. This ordinance shall take effect upon its approval.

This Bill amends the Hamakua District Homesteads Area Zone
Map by changing the district classification from Agricultural
(A-Sa) to Agricultural (A-la) at Kaao Homesteads, Hamakua.
Date Introduced: May 31, 1973

Office of the County Clerk for use and examination by the public.
