AN ORDINANCE AMENDING SECTION 7.29, THE CITY OF HILO ZONE MAP, ORDINANCE
N0. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII
1967, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICUL-
TURAL (A-20a) TO AGRICULTURAL (A-la) AT PONAHAWAI, SOUTH HILO, HAWAII,
COVERED BY TAX MAP KEY 2-5-02:13.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29 of Ordinance No. 63 (Zoning Ordinance)
Revised Ordinances of the County of Hawaii 1967, as amended, is hereby
further amended by adding thereto the following subsection:
"7.29(0). The district classification of the following area
situated at Ponahawai, South Hilo, Hawaii, shall be Agricultural
(A-la):
Beginning at the southwest corner of this parcel of land at the
southeast corner of Increment 1-B of Kaumana City Subdivision (File
Plan 1012) the coordinates of said point of beginning referred to
Government Survey Triangulation Station "HAIA I" being 12,670.64
feet South and 29,037.79 feet West and running by azimuths measured
clockwise from true South:

Exhibit "A" and by r eference m ade a part hereof."
SECTION 2. Sec tion 1 of this ordinance shall take effect forthwith
upon the conditi ons that (A) the ar ea be zoned into four increments. The
first three increments shall each consist of a maximum sixty (60) lots
- 2 -
and the fourth increment the remaining lots. The effective date of
zoning for subsequent increments shall be after development has occurred
on the previous increment or combination of increments. Development is
defined as building permits issued for residential dwelling units and
construction partially completed in the sense of having walls on the
units - on thirty (30) per cent of the lots of the previous increment or
combination of increments. This would assure development on a minimum of
twenty-five (25) per cent of the total lots or sixty (60) dwellings; (B)
a minimum of five (5) acres be set aside and improved by the owner for
active recreational purposes. Improvement of the recreational area shall
include but not necessarily be limited to the area being graded and grassed.
At the time of subdivision review, the Planning and Parks and Recreation
Departments shall determine the location, configuration and the improve-
ments of the park area; and (C) the applicant, Mr. Norman N. Inaba, sub-
mit and secure tentative approval of a subdivision plan within one year
from the date of approval of the change of zone. The applicant shall
also assume the responsibility for securing final subdivision approval of
the subject area. Should these conditions not be met, action may be
taken to nullify any subdivision approval and to reclassify the subject
area to a more appropriate designation.
SECTION 3. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts of
this ordinance.
