Home My WebLink AboutORD 1973-594BILL No. 99$ COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO. ~~°~ AN ORDINANCE AMENDING SECTION 7.04, THE KAILUA URBAN ZONE MAP, ORDINANCE N0. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM DOUBLE FAMILY RESIDENTIAL (RD-3.75) TO MULTIPLE FAMILY RESIDENTIAL (RM-1.25) AT HIENALOLI 5TH, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-5-23:64, 65 AND 66. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.04 of Ordinance No. 63 (Zoning Ordinance) Revised Ordinances of the County of Hawaii 1967, as amended, is hereby further amended by adding thereto the following subsection: "7.04(j). The district classification of the following area situated at Hienaloli 5th, North Kona, Hawaii, shall be Multiple Family Residential (RM-1.25): Beginning at the west corner of this parcel of land and on the north- east side of Hualalai Road (Kailua to Holualoa), the coordinates of said point of beginning referred to Government Survey Triangulation Station "N orth Meridi an" being 2078.04 feet South and 2121.51 feet East, and running by azimuths measured clockwise from true South: 1. 260° 52' 390.28 feet along R. P. 1930, No. 1 to Asa Thurston, L. C. Award 387, Part 4, Section 2 to American Board of Com- missioners for Foreign Missions; 2. 350° 52' 99.80 feet along Lot 377; 3. 268° 20' 56.00 feet along Lot 377; 4. 342° O1' 11.86 feet along Lot 377; 5. 72° Ol' 30.67 feet along the northerly side of Hualalai Road (Kailua to Holualoa); 6. 88° 20' 369.67 feet along Government Land; 7. 134° 30' 38.74 feet along the northeasterly side of Hualalai Road (Kailua to Holualoa); 8. 138° 44' 52.29 feet along the northeasterly side of Hualalai Road (Kailua to Holualoa) to the point of beginning and con- taining an area of 36,182 square feet. "All as outlined in red on the map attached hereto, marked Exhibit "A " and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the proposed development comply with the goals, policies and standards for multi-residential developments as out- lined in the General Plan document and comply with all other applicable regulations; (B) construction commence within one (1) year of the date of approval of the change of zone; and (C) the price of the units be within the low and moderate price market as determined by appropriate agencies. Should these conditions not be met, rezoning may be initiated of the sub- ject area to a more appropriate designation. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
