Home My WebLink AboutORD 1973-604BILL NO. 100$ COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO. ~jl'Q AN ORDINANCE AMENDING SECTION 7.29, THE CITY OF HILO ZONE MAP, ORDINANCE NO. 63 (ZONING ORDINANCE), REVISED ORDINANCES OF THE COUNTY OF HAWAII 1967, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE-FAMILY RESIDEN- TIAL (RS-7.5) TO NEIGHBORHOOD COMMERCIAL (CN-10), AT PUNAHOA 2ND, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEY 2-3-34:65. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.29 of Ordinance No. 63 (Zoning Ordinance) Re- wised Ordinances of the County of Hawaii 1967, as amended, is hereby further amended by adding thereto the following subsection: "7.29(p). The district classification of the following area sit- uated at Punahoa 2nd, South Hilo, Hawaii, shall be Neighborhood Com- mercial (CN-10): Beginning at the North corner of this lot, the West corner of Hualilili and Kaumana Roads, the coordinates of said point of beginning being referred to Government Survey Triangulation Station "HALM ," being 493.21 feet South and 2,646.52 feet West, thence running by azimuths measured clockwise from True South: 1. 316° 15' 159.89 feet along Hualilili Road; 2. 46 ° 15' 75.00 feet along Lot 5, Block N; 3. 136° 15' 158.62 feet along Lot 3, Block N to Kaumana Road; 4. 225° 17' 75.01 feet along Kaumana Road to the point of beginning and containing an Area of 11,944 Square Feet, more or less. All as outlined in red on the map attached hereto, marked Exhibit "A" and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the amount of available parking would determine the amount of usable commercial space; (B) improvements be made to Hualilili Street which shall include a minimum pavement width of 16 feet; and (C) the applicant, Tadayoshi Ishizu, be responsible for securing a building permit and assuring construction started for improvements to the second story for commercial office uses or a maximum of one residential unit use within one year from the official date of approval of the change of zone. All future developments shall also be limited to commercial and single-Family resi- dential uses. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this Ordinance. SECTION 4. This ordinance shall take effect upon its approval.
