HomeMy WebLinkAboutORD 1973-613_. :.,,-. -; BILL NO. 1018 REVISED COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO. h~ <.3 AN ORDINANCE Ab4EDIDING SECTION 7.24, THE KA'U DISTRICT ZONE MAP, ARTICLE 2, CHAPTER 8 (ZONING CODE), HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM MULTIPLE FAP4ILY RESIDENTIAL (RM-2) TO OPEN (O) AND FROM OPEN (O) TO MULTIPLE FADIILY RESIDENTIAL (RM-2) AT WAILAU AND NINOLE, KA'U, N1IWAII, COVERED BY TAX MAP KEY 9-5-19:PORTIONS OF 15, 25 AND 26. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.24 of Article 2, Chapter 8 (Zoning Code), Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsections: "7 24(f-1), The district classification of the following area situated at Ninole, Ka'u, Hawaii, shall be open (O): Beginning at the northeast corner of this parcel of land, the coordinates of which referred to Government Survey Triangulation Station 'HILL' (Puehu) being 2,652.71 feet South and 666.20 feet East and running by azimuths measured clockwise from true South: 1. 345° 15' 184.16 feet along remainder of Grant 825 to S, Kaui (along remain der of Parcel 3); 2. 354° 22' 439.21 feet along remainder of Grant 825 to S. Kaui (along remain der of Parcel 3); 3. 150° 55' 257.00 feet along remainder of Grant 825 to S . Y.aui ; 4. 184° 25' 240.00 feet along remainder of Grant 825 to S, Kaui; 5. 181° 45' 143.52 feet along remainder of Grant 825 to S. Kaui; 6. 237° 00' 14,38 feet along remainder of Grant 825 to S. Kaui to the point of beginn ing and containing an area o f 0.830 acre. "7.24 (f-2). The district classification of the following area situated at Ninole and Wailau, Ka'u, Hawaii, shall be Multiple Family Residential (RM-2): Beginning at the east corner of this parcel of land, being also the north corner of Parcel 3, the coordinates of which referred to Government Survey Triangulation Station 'HILL' (Puehu) being 2,221.31 feet South and 379.39 feet East, and running by azimuths measured clockwise from true South: 1. 76° 45' 331.85 feet along remainders of Grant 828 to Kekaula and Grant 823 to Kulaikahuna (along Parcel 3); 2. 162° 55' 40.78 feet along remainder of Grant 823 to Kulaikahuna (along centerline of proposed Ninole Loop Road); 3. 256° 45' 310.50 feet along remainders of Grant 823 to Kulaikahuna and Grant 828 to Kekaula; 4. 316° 07' 47.28 feet along remainder of Grant 828 to Kekaula to the point of beginning and containing an area of 0.300 acre. "7.2 4 (f-3). The district classification of the following area situated at Ninole and Wailau, Ka'u, Hawaii, shall be Multiple Family Residential (RD4-2): Beginning at the north corner of this parcel of land, being also the northeast corner of Parcel 3, the coordinates of which referred to Government Survey Triangulation Station 'HILL' (Puehu) being 2,704.96 feet South and 844.53 feet East and running by azimuths measured clockwise from true South: 1. 316° 07' 79.19 feet along remainder of Grant 828 to Kekaula; 2. 11° 15' 462.28 feet along remainders of Grant 828 to Kekaula and Grant 825 to S. Kaui; 3. 97° 18' 29.86 feet along remainder of Grant 825 to S. Kaui (along centerline of proposed Ninole Loop Road); 4. 187° 18' 510.84 feet along remainders of Grant 825 to S. Kaui and Grant 828 to Kekaula (along Parcel 3) to the point of beginning and containing an area of 0.510 acre. -2- '"All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the condition that the applicant submit and secure tentative approval of the proposed resubdivision within one (1) year of the date of approval of the change of zone. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
