ORDINANCE NO. 1
AN ORDINANCE PROVIDING EP~RGENCY POWERS TO THE MAYOR OF THE
COUNTY OF HAWAII: IN ALLEVIATING PROBLEMS CREATED BY THE
GAS SHORTAGE.
WHEREAS, there is an acute shortage of gasoline in
the County of Hawaii; and
WHEREAS, a GASPLAN has been implemented by the Mayor of
the County of Hawaii by proclamation dated January 26, 1974;
and
WHEREAS, the gas shortage is causing great undue economic
hardship; and
WHEREAS, the hoarding of gasoline has aggravated the
hardships created by the gas shortage; and
WHEREAS, the shortage of gasoline has created an immediate
need for a bus system,
NOW, THEREE'ORE, BE IT ORDAINED BY THE COUNCIL OF THE
COUNTY OF HAWAII:
SECTION 1. FINDING OF EMERGENCY.
The Counci]. hereby declares that a state of emergency
exists in the County due to the problems arising out of the
qas shortage.
SECTION 2. GASPLAN.
A. The Council hereby endorses the implementation of
the GASPLAN as by the Mayor proclaimed on January 26, 1974.
B. Hoarding. No gasoline shall be stored in excess
of a total of five (5) gallons in or outside any dwelling,
place of human habitation or place of public assembly. The
gasoline shall be kept in an approved safety can or cans.
This prohibition shall not apply to the storage of gasoline
in the fuel tank of a registered motor vehicle, aircraft,
motorboat or mobile power plant, farming or any exemptions
permitted by tkie Fire Chief.
C. Penalty. Any person, corporation, partnership or any other
legal entity iri violation of the provisions of this ordinance
shall be deemed to be guilty of a misdemeanor and upon conviction
thereof shall be punished by a fine not to exceed $500 or
six months in fail, or both, for each and every offense.
SECTION 3. BUS SYSTEM.
The Council hereby endorses and pledges its support to
implement any transportation system which may be necessary to
provide transportation for the safety, health and welfare of
the people of t:he County put into effect by the Mayor.
SECTION 4. OTHER EMERGENCY POWERS GRANTED TO THE MAYOR.
The Mayor is hereby authorized to provide for any measures
necessary to alleviate the problems created by the gas shortage
in pursuit of i~he policies and plans provided herein.
SECTION 5» SEVERABILITY.
If any provision of this ordinance or its application
to any personal circumstance shall be held unconstitutional
or invalid, the: remainder of this ordinance and the
application of such portion to other persons or circumstances
shall not be affected thereby.
SECTION 6. EFFECTIVE DATE.
This ordinance shall take effect upon approval and shall
automatically :stand repealed as of the sixty-first day
following the ciate of adoptio of this ordinance.
