BE IT ORDAINED BY THE CO[ SECTION 1. Section County Code, as amended, following subsection: "7.29(r). The situated at Waiakea JNCIL OF THE COUNTY OF HAWAII: 7.29 of Chapter 8 (Zoning Code), Article 2, Hawaii is hereby further amended by adding thereto the district classification of the following area Homesteads, Waiakea, South Hilo, Hawaii, shall be Agricultural (A-la): Beginning at the southeast corner of this parcel of land, the coordi- nates of said point of beginning referred to Government Survey Triangu- lation Station "HALAI" being 17647.40 feet South and 5721.67 feet East, and running by azimuths measured clockwise from true South: 1. 85° 40' 968.00 feet along the remainder of Grant 10518:2; 2. 175° 40' 225.00 feet along Lot 912, Waiakea Homesteads; 3. 265° 40' 968.00 feet along the southerly side of Anela Nani Subdivision to the southwest corner of Lot 907, Waiakea Homesteads; 4. 355° 40' 225.00 feet along the remainder of Grant 10518:2 to the point of beginning and containing an area of 5.00 acres. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the applicant, Hirosuke Akamine, submit and secure tentative approval of the proposed subdivision within one (1) year of the date of approval of the change of zone; (B) one (1) dwelling be con- structed on the resultant lots within one (1) year of the date of final subdivision approval; and (C) a 50-foot right-of-way, which would be a continuation of Akea Street, be set aside through the width of the proposed subdivision. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
