AN ORDINANCE AMENDING SECTION 7.02, THE NORTH KONA ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWA I COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM UNPLANNED (U) TO AGRICULTURAL (A-la) AT KALAOA 1ST AND 2ND, NOP,TH, KON1A, HAWAII, COVERED BY TAX MAP KEY 7-3-11:49. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Secticn 7.02 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.02~~. TYie district classification of the following area situated at Kalaoa 1st and 2nd, North Kona, Hawaii, shall be Agri- cultural (A-la): Beginning at a pipe in concrete at the southeast corner of this parcel of land, the coordinates pf which referred to Government Survey Tri- angulation Station "MOANU$AHEA" being 4614.00 feet South and 8759.10 feet West, and thence running by azimuth measured clockwise from true South: Along stone wall, along r@mainder of Grant 3027 to Heueu for the following nine (9) course: 1. 86° 20' 30" 37.95 feet to a pipe in concrete; 2. 93° 28' 3'0" 78.47 feet to a pipe in concrete; 3. 95° 20' 3'0" 104.89 feet to a pipe in concrete; 4. 88° 34' 45.03 feet to a pipe in concrete; 5. 93° 09' ?.0" 39.38 feet to a pipe in concrete; 6. 78° 11' 3'.0" 35.29 feet to a pipe in concrete; 7. 85° 00' 22.97 feet to a pipe in concrete; 6. 97° 49' 30.06 feet to a pipe in concrete; 9. 191° 47' 383.27 feet to a pipe in concrete, thence; 10. 268° 17' 1.5" 278.20 feet along remaind er of Grant 3027 to Heueu to a pipe in concrete; Thence along the westerly side of Hawaii Belt Road, F. A. P. F 10 (5) on a 5769.58 feet radius curve to the left, the chord azimuth and dis- tance being: 11. 355° 13' 2Ei" 249.82 feet to a pipe in concrete; 12. 353° 59' 143.35 feet along the westerly side of Hawaii Belt Road, F. A. P. F 10 (5), to the point of beginning and containing an area of 2.918 acres. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by referen<:e made ~ part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that: (A) the applicant, John Mahi, submit and secure tentative approval of tyre proposed subdivision within one (1) year of the date of approval of the zone change; (B) construction of another dwelling on the land begin within one (1) year of the date of final subdivision approval; and (C) should these conditions not be met, action may be taken to rezone the area into a more appropriate classification. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. The ordinance shall take effect upon its approval.
