BE IT ORDAINED BY THE COUNCIL 07+' THE COUNTY OF HAWAII: SECTION 1. Section 7.03 o:f Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.03(n). The district classification of the following area situated at Onouli 2nd, South Kona, Hawaii, shall be Agricultural (A-la): Beginning at a pipe in concrete at the northeast corner of this parcel of land, the coordinates of which referred to Government Survey Triangulation Station "PUU OHFiU" being 3,228.78 feet South and 11,176.41 feet East, and thence running by azimuths measured clockwise from trite South: 1. 359° 51' 3G~~ 120.00 feet along the westerly side of Hawaii Belt Road; 2. 268° 32' 04" 10.41 feet along jog in right-of-way of Hawaii Belt Road; Thence along the westerly :side of Hawaii Belt Road on a 1667.28 foot radius curve to the left, the chord azimuth and distance being: 3• 3550 55' 29.3" 153.67 feet; Thence along remainder of Grant 1162 to F. 0. Schulze for the following six (6) courses: 4. 84° 42' 30" 240.17 feet to a pipe in concrete; 5- 750 35' 120.70 feet to a pipe in concrete; 6. 82° 07' 15" 201.72 feet to a pipe in concrete; 7. 175° 51' 30" 43.14 feet to a pipe in concrete; 8. 186° 53' 30" 233.11 feet to a pipe in concrete; g. 261° 15' 515.38 feet to the po int of beginning and containing an area of 3.305 Acres. "A11 as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the condition that the owner or lessee o£ the subject ;area submit a subdivision plan for preliminary approval no later than one year from the date of County Council approval of the subject request. Should this condition not be mf:t, the Planning Commission shall reserve the right to initiate action to rezone the subject area to its original designation. SECTION 3. In the event ghat any portion of this ordinance is declared invalid, such invalidity shall not affect the other pax•ts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
