HomeMy WebLinkAboutORD 1974-039BILL N0. 42 COUNTY OF FCAWAII - STATE OF HAWAII ORDINANCE N0. ~~ AN ORDINANCE AMENDING SECTION '7.21, THE',KEAAU ZONE MAP, OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS P.MENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE FAMILY RESIDENTIAL (RS-15) TO SINGLE FAMILY RESIDENTIAL (RS-10) AT KEAAU, PUNA, HAWAII, COVERED BY TAX MAP KEY 1-6-144:42. BE IT ORDAINED BY THE COUNCIL OF THE COiINTY OF HAWAII: SECTION 1. Section '7.21 of Chapte~+ 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.21(b). The district classiification of the following area situated at Keaau, Puna, Hawaii, shall be Single Fami$y Residential (RS-10): Beginning at the northeast corn er of this parcel of land and on the westerly side of a 60-foot road (portion of Lot 8838, Land Court Application 1053, Map 143), the coordi- nates of said point of beginnin g referred to Government Survey Triangulation Station "OLAA" bei ng 8964.09 feet North anc~ 662'7.03 feet East, and running by azimuths measured clockwise from true South: 1. 338° 40' 589.:10 feet along the westerly side of a 60-foot road (portion of Lot 8835, Land Court Applica- tion 1053, Map 143) and along Lot 8833, Land Court Application 1053, Map 143; thence follow- ing along Lot 8833, Land Court Application 1053, Map 143, on a curve to the right having a radius of 80.51 feet, the chord azimuth and distance being: 2. 347° 07' 12" 255.94 feet; 3. ']1° 48' 11" 153.12 feet along Lot 1298-A-2, Land Court Application 1053, Map 88; thence following along Lot 1298-B, Land Court Application 1053, Map 42, on a curve to the left having a radius of 345.00 feet, the chord azimuth and distance being: 4. 160° 14' 05.5" 18.88 feet; 5. 158° 40' 815.00 feet along Lot 1298-B, Land Court Application 1053, Map 42; 6. 248° 40' 190.00 feet along Lots 118'], 1188 and 1189 Land Court Application 1053, Map 34, to the point of beginning and containing an area of 3.58'7 acres. "All as outlined in :red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the condition that (A) the applicant, Keaau ".,and Company, Ltd., submit a subdivision plan and secure tentative approval within one (1) year from the date of approval of the change of zone request; and (B) a minimum of three (3)Ilsingle-family dwellings be constructed on three (3) of the lots within three (3) years ~f receipt of final subdivision approval. SECTION 3. In the event that any portion of this ordinance is declared .invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall tike effect upon its approval.
