AN ORDINANCE AMENDING SECTION 7'29, THE CITY OF HILO ZONE MAP, OF CHAPTER
8 (ZONING CODE), ARTICLE: 2, HAW II COUNTY CODE, AS AMENDED, BY CHANGING
THE DISTRICT CLASSIFICATION FRO AGRICULTURAL (A-20a) to SINGLE-FAMILY
RESIDENTIAL (RS-10) and MULTIPL -FAMILY RESIDENTIAL (RM-4) AT KUKUAU 2ND,
SOUTH HILO, HAWAII, COVERED BY AX MAP KEY 2-5-46: PORTION OF 1.
BE IT ORDAINED BY THE COUNCIL O$' THE COUNTY OF HAWAII:
SECTION 1. Section 7.29 of Chapter 8 (Zoning Code), Article 2, Hawaii
County Code, as amended, is herby further amended by adding thereto the
following subsection:
"7.29(v-1). 7'he disttict classification of the following area
situated at Kukuau 2nd, So~th Hilo, Hawaii, shall be Multiple-Family
Residential (RM-4):
Beginning at the northwest', corner of this parcel of land, the coor-
dinates of said point of b ginning referred to Government Survey
Trian ulation Station "KAU NA" bein 1901.22 feet South and 2225.99

'A' and by reference made a part hereof."
SECTION 2. Section 1 of this ordinance shall take effect forthwith
upon the conditions that: (A) the area be zoned in two (2) single-family
residential increments and five (5) multiple-family residential increments.
(a) Construction of the single-family residential units shall not commence
in zoning Increment 2 until development has occurred in the single-family
residential zoned area of Increment 1. Development is defined as building
permits issued for the single-family units and construction partially
completed - partially completed in the sense of having roofs on 13 units
within the single-family residential zoned area of zoning Increment 1 to
assure that a minimum of` 40 percent of the lots are developed with single-
family residential units. (b) ('onstruction of the multiple-family resi-
dential zoned area in zoning Increment 2 shall not commence until fifteen
(15) percent of the mult:iple-family residential zoned area in zoning
Increment 1 has been developed. Construction of all subsequent mutiple-
family residential zoneci increments shall not commence until fifteen (15)
percent of the previous zoning increments are developed; (B) a Planned
Unit Development application be initially submitted for a minimum of ten
(10) acres of the multiple-family residential zoned area in zoning Incre-
ment 1. A Planned Unit Development application shall be submitted for all

subsequent multiple-family residential zoning increments. With the excep-
tion of the model units, construction of any new units shall not commence
until the Planned Unit Development permit has been processed and approved;
(C) the applicant, Gentx-y-Hawaiiana, submit a subdivision plan for the
RS-10 zoned area of Increment 1 and secure tentative approval within one
(1) year of the date of approval of the change of zone. The applicant shall
also be responsible for securing final subdivision approval; (D) a minimum
school/park area of fourteen (14) acres be provided in close proximity
of the area to serve the proposed residential development. The school
site shall consist of a minimum of six (6) acres and the park area shall
consist of a minimum of eight (8) acres. Minimum improvements shall be
provided for at least four (4) acres of the park area prior to construc-
tion of Increment 3 and the remaining area shall be improved before comple-
tion of the proposed development:. Minimum improvements shall include but
not be limited to grading and grassing which meet the approval of the Parks
and Recreation Director. The park shall remain in private ownership and
maintenance until such time that the applicant decides to dedicate the area
and accepted by the County. The exact location and configuration of the
school/park area shall be determined by the appropriate agencies and mutu-
ally agreed upon by the applicant; (E) a temporary sewerage system be pro-
vided during the construction oi- the first and second increments. Said
system shall meet with t:he requirements of the Department of Health and
shall be jointly determined by the Planning Director and the Chief Engi-
neer. A permanent sewerage system and treatment plant shall be constructed
before the effective date of the fourth zoning increment; (F) all other
applicable regulations including the "plan approval" process be complied
w i t h. S hould any of the foregoing conditions not be met, rezoning
of the property to its former zoning designation shall be initiated.
SECTION 3. In the event that any portion of this ordinance is de-
clared invalid, such invalidity shall not affect the other parts of this

SECTION 4. This ordinance shall take effect upon its approval.
