ORDINANCE NO. ~'~;
AN ORDINANCE AMENDING CHAPTER 8 (ZONING CODE), HAWAII COUNTY
CODE, RELATING TO PROCEDURES FOR THE ADMINISTRATION AND
ENFORCEMENT THEREOF.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 8, Article 27, subsection H-2(a)(4)
is hereby amended by addition of the words "and County Council"
after the word "public" and before the word "reviewing."
SECTION 2. Chapter 8, Article 27, subsection H-2(b)(1)
is hereby amended by addition of the following sentences:
"The Planning Director shall submit the information
received from the applicant to the County Council for
review, comments and recommendations. The County Council
shall submit its comments and recommendations, if any,
to the Planning Director within fifteen (15) days of the
date of receipt of the information."
SECTION 3
Article 28:
Chapter 8 is hereby amended by adding thereto
"ARTICLE 28
Severability
Sec. 1
GENERAL PROVISION. If any portion of
this ch<~pter or article, or its application to any person
or circumstance, shall be held unconstitutional or invalid
because it violates any provision of the Hawaii County
Charter or for any other reason, the remainder of the
chapter or article and the application of such portion
to other persons or circumstances shall not be affected
thereby."
SECTION 4. This ordinance shall take effect upon
its approval.
