HomeMy WebLinkAboutORD 1974-048BILL NO. 54 COUN'.PY OF HAWAII - STATE OF HAWAII rt~- ORDIN~NCE NO. ~~ AN ORDINANCE AMENDING SEC'.CION 7.09, THE KAMUELA ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CDDE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-5a) TO AGRICULTURAL (A-3a) AT PUUKAPU HOMESTEADS, FIRST SERIES, PUUKAPU, SOUTH KOHALA, HAWAII, COVERED BY TAX MAP KEY 6-4-01: 1, 2 and 72. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section '7.09 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, :is hereby further amended by adding thereto the following subsection: "7.09pz). The c9istrict classification of the following area situated at Puukapu Homesteads, First Series, Puukapu, South Kohala, Hawaii, shall be Agricultural (A-3a): Beginning at a point at the north corner of this tract of land, being also the west corner of Lot A, portion of Grant 4741 to Martin Campbell and on the south side of the Mamalahoa Highway, the coordinates of said point of beginning r.=_ferred to Government Survey Triangulation Station "WEST BASE" being 1124.50 feet North and 7744.99 feet East and running by azimuths measured clockwise from True South: 1. 329° 07' 560.32 feet along Lot A, subdivision of Lot 39, Grant 4741 to Martin Campbell; 2. 254° 44' 271.50 feet to a pipe; 3. 329° 07' 1665.90 feet along the Southwest side of a home- stead road to a pipe; 4. 74° 44' 671.50 feet along Kahilu Road; 5. 149° 07' 2220.45 feet along Lots 36 and 35, Grant 4017 to Wilmot Vredenberg; 6. 253° 56' 398.48 feet along the south side of the Mamalahoa Highway to the point of beginning and containing an area of 29.6626 Acr es. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the applicant, Chung Dho Ahn, submit a subdivision plan and secure tentative approval within one (1) year of the date of approval of the request; and (B) the area be zoned in two (2) increments. The first increment shall consist of six (E) lots; the second, the remaining lots. The effective date of zoning for the second increment shall be after agricultural development has occurred on the first zoning increment. Agricultural develop- ment is defined as the active cultivation or production of land for agricul- tural purposes as determined by the State Department of Agriculture and the County Planning Department on a minimum of three (3) lots of the first incre- ment. Each of the three (3) lots shall be cultivated on a minimum fifty (50) percent of the lot area. Should any of the foregoing conditions not be met, rezoning of the property to its former zoning designation shall be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
