BILL NO. 53 (AMENDED~- COUNTY OF HFIWAII - STATE OF HAWAII ORDINANCE NO. 7Q1 AN ORDINANCE AMENDING SECTION 7«18, THE PUNA DISTRICT ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-20a) TO AGRICULTURAL (A-la) AT OLAA RESERVATION LOTS, OLAA, PUNA, HAWAII, COVERED BY TAX MAP KEY 1-8-04: PORTION OF 2. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.18 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.18(g). The district classification of the following area situated at Olaa Reservation Lots, Olaa, Puna, Hawaii, shall be Agricultural (A-la): Beginning at the West corner of this parcel of land, also being the South corner of Grant 11632 to Tatsuhiko Omori and Tsuyuka Omori Mendoza on the Northeasterly boundary of Grant 4027 to A. Zimmerman and Annie Zimmerman (Mountain View School Lot), the coordinates of said point of beginning referred to Government Survey Triangulation Station "OLAA", being 16,091.58 feet South and 15,919.08 feet West and running by azimuths measured clockwise from true South: 1. 228° 53' 30" 2. 138° 53' 30" 3. 228° 53' 30" 4. 318° 53' 30" 5. 228° 53' 30" 6. 318° 53' 30" 7. 48° 53' 30" 8. 138° 53' 30" 705.00 feet along Grants 11632 and 10615; 142.81 feet along Grant 10615 to the Southeast side of the New Volcano Road; 900.00 feet along the Southeast side of the New Volcano Road; 142.81 feet along Grant 12738; 395.00 feet along Grants 12738 and 10202:2 and Government Land to the Southwest side of a 30-Foot Homestead Road; 1,583.59 feet along the Southwest side of a 30-Foot Homestead Road; 366.12 feet along the remainder of Grant 4025; 890.05 feet along the same; 9. 48° 53' 30" 394.12 feet along the same; 10. 318° 53' 30" 36.70 feet along the same; 11. 48° 53' 30" 739.76 feet along the same; 12. 138° 53' 30" 730.24 feet along Grant 4027 to the point of beginning and con- taining an area of 33.298 acres. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of t}iis ordinance shall take effect forthwith upon the conditions that: (A) they area be zoned in two (2) increments. The first increment shall consist o= twenty-three (23) acres and the second increment, the remaining area. The effective date of zoning for the second increment shall be after residential and agricultural developments have occurred on the first increment. Residential development is defined as building permits issued for single-family residential dwelling units and construction partia:ly completed -- partially completed in a sense of having roofs on a minimum of twenty-five (25) percent of the units for the entire 33.298 acres. Agricultural development is defined as the active cultivation or production of land for agricultural purposes as determined by the Country Planning Department on a minimum of twenty-five (25) percent of the lots within the entire 33.298 acres of which a minimum of fifty (50) percent of the lot shall be cultivated; (B) the applicants, Minoru Shigeoka and Hiromu Yamanaka, submit and secure tentative approval of Increment one (1) of the proposed subdivision within one (1) year from the date of approval of the change of zone and also assume the responsi- bility of securing final subdivison approval for the first increment. The applicants shall also be responsible for securing preliminary and final subdivision approvals for the second zoning increment; (C) the portion of Kulani Road fronting th.e subject property be improved to a 50-foot right- of-way with a 20-foot pavement. An additional five (5) feet be set aside -2- for future road widening of Kulani Road to an 80-foot right-of-way as stipulated in the General Plan c'~ocument; and (D) the applicants, Minoru Shigeoka and Hiromu Yamanaka, pzovide a cash contribution to the County of Hawaii equivalent to the sum of two hundred fifty dollars ($250.00) per lot. Said funds shall be expended by the County to further the area's park and recreational developmer.,t programs. Should any of the foregoing conditions not be met, rezoning of the property to its former zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
