AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 3, HAWAII COUNTY CODE,
BY ADDING A NEW SECTION CONCERNING REGULATION OF PARKING AT THE
COUNTY BUILDING AND ESTABLISHMENT OF PARKING FEES FOR COUNTY
PERSONNEL.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. This ordinance supersedes any prior ordinance
or resolution which regulates parking at the County Building
in Hilo, Hawaii, or sets parking fees at this location.
SECTION 2. General objectives are to attempt to provide
an adequate number of metered and/or unmetered stalls for the
public, reserved and "theater parking" areas for government
officials and employees at a reasonable rental.
SECTION 3. Chapter 2, Article 3, is amended by adding
the following sections:
"SEC. 1.20. ASSIGNMENT OF PARKING STALLS. The
Chief Engineer shall assign and re-assign parking stalls
and be responsible for regulating parking at the County
Building.
"SEC. 1.21. Area of County land involved will
initially be confined to the Hawaii County Building
Complex in Hilo. Other areas of County lands may be
subjected to parking controls and this section shall
also be applicable to those areas on a date to be
designated in a written notice thereof, which date
shall be not less than 30 days after the giving of
such notice.
"SEC. 1.22. RENTAL AND METER CHARGES.
"(a) The rates for metered stalls shall be set
by the Director of Finance. Rental in 'theater parking,'
reserved parking and the multi-level parking structure
shall be established by the Director of Finance. The
Director of Finance may change the rates effective as
of a date to be designated in a written notice thereof,
which date shal] be not less than 30 days after the
giving of such notice.
"(b) The rental for reserved, 'theater parking'
and multi-level parking shall be on a month-to-month
term, the applicable rent to be in advance without
notice or demand. County employees shall utilize
payroll deduction for the payment of the parking stalls.
"(c) Rentals shall be computed on a semi-monthly and
monthly basis applicable to permanent and temporary
parking privileges.
"SEC. 1.23. APPLICATION AND ASSIGNMENT PROCEDURES.
"(a) It shall be the responsibility of each government
official or employee to make his application for 'theater'.
reserved, or multi-level parking structure to express
his preference as to location with alternative choices,
on the form that will be provided by the Department of
Public Works. T'he assignment of parking spaces shall
be made by the Department of Public Works to only the
applicants' registered vehicle(s) and according to the
best utilization of available parking spaces on County
lands within his jurisdiction.
"(b) The Department of Public Works at its
discretion may review, modify or change employee
assignments in specific areas when circumstances warrant
such changes and. after proper notice to government

"(b) Signs.. All official signs and pavement
markings must bE~ observed, and all signs and pavement
parking posted Linder the direction of the Department
of Public Works shall be deemed to be official signs.
"(c) Prohibited parking areas. Parking shall be
permitted only in areas marked and specified for parking.
Automobiles parked in prohibited areas shall be towed
away at the expense of the owner and the deputized
County employees and police officers shall be authorized
to enforce this rule.
"(d) No person without a proper parking permit
shall park in either a reserved, 'theater' parking space
or multi-level F~arking structure and no permittee,
without written consent of the Department of Public
Works, shall let. or assign any person to park in his
reserved, 'theat.er,' or multi-level parking structure
parking space.
"(e) Appropriate area identifications shall be
provided to be affixed on the vehicles. Parking privileges
shall be valid in only designated areas.
"(f) In ar.y proceeding for violation of the parking
provisions of tr.is ordinance, the Serial number displayed
on the registration plate attached to the vehicle
involved. in such violation shall constitute prima facie
evidence. that the registered owner of such vehicle was
the person who narked such vehicle at the point where,
and during the tame when, such violation occurred.
"(g) Citations. Vehicles parked overtime in
metered areas sYiall receive citations equivalent to

official. and emF>loyee so as to best promote governmental
efficiency and F~ublic convenience.
"(c) Special parking permits may be issued by the
Department of Public Works at its discretion, on a
temporary basis so as to accommodate the necessary
intermitaent needs of governmental operation.
"SE;C. 1.24. MAP OF PARKING CONTROL AREA.
"The map oi` the parking control areas shall be
kept at the Dep~irtment of Public Works. The Department
of Public Works reserves the right to change the number
of parking spacE~s for reserved parking, 'theater parking,'
and multi-level parking structure and metered parking
based on. the availability and demand for the respective
types of parking, without the necessity of public notice;
such changes shall be recorded on the map of the parking
control area keF~t in the office.
"SE;C. 1.2_`i. PARKING DURING COUNCIL OR COMMITTEE
SESSIONS; SPECIAL OCCASIONS.
"During these sessions or any other time when public
demand for parking is high, e.g., annual relicensing
period, parking privileges and restrictions may be
subject to chancre, with the Department of Public Works
to accomplish tYie necessary shifting of parking privileges
and rest:riction:; so as to cause the least possible
inconvenience to those renting parking spaces.
"SF'sC. 1.26. GENERAL PROVISIONS.
"(a) Enforcement. This ordinance shall be enforced
by duly deputized County employees as well as by the
police officers of the County.

Vehicles without: authorized parking privilege
identifications shall receive citations.
"(h) Whenever a government official or employee
terminates his services with the County or disposes of
a registered vehicle and relinquishes his parking permit,
it shall be his responsibility to remove or surrender
the parking decal as proof of such termination or
disposition and notify the Department of Public Works
in writing on the form provided in order that proper
accounting can re made.
"(i) Provisions of this ordinance shall have
application only during the regular working hours of
the County.
"SEC. 1.27. PENALTY.
"Violators of this ordinance shall be guilty of a
misdemeanor and may be fined not more than Five Dollars
($5.00) for each violation. Parking privileges may be
permanently revoked for violation of these rules and
regulations.
"SEC. 1.28. SEVERABILITY.
"If any prevision of this ordinance or the application
thereof to any Ferson or circumstances is held invalid, such
invalidity shall not affect other provisions or applications
of the ordinance which can be given effect without the
invalid provision or application, and to this end the
provisions of this ordinance are declared to be severable.

"SE'C. 1.25. EFFECTIVE DATE.
"This ordinance shall take effect as soon as
preparations have been made to the parking area, duly
posted with the proper signs, and government officials'
and County employees' cars are properly identified."
