AN ORDINANCE TO A!~1END CHAPTER 2 OF THE HAWAII COLR~TY CODE, 1983
(1995 EDITION) AS Ah1E\DED TO ALLOW THE NEGOTIATED DISPOSITIOti OF
REAL PROPERTY FOR AFFORDABLE HOUSING PROJECTS
BE IT ORDAINED BY THE COUNCIL OF THE COCT~TY OF HAWAII
Section I Findings Section 2-120 (a) (2). of the Hawaii County Code allows the
finance director to negotiate the leasing of real property to nonprofit organ¢ations,
Section 2-120 (a) (3), of the Hawai i County Code allows the finance director to negotiate the
etchange of real property to nonpmtit organizations. Section 2-120 (a) (4). of the Hawaii
Count} Code allows the finance director to negotiate the granting of licenses, permits and
easements to nonprofit organizations, the Hawaii County Housing Agency is seeking to
amend Section 2-120 (a) (2), of the Hawaii Counn Code to allow the finance director to
negotiate the selling m fee simple of real property to develop affordable housing
Section 2 Chapter 2, Section l20 (a) (1), of the Hawaii County Code 1983 (1995
Ediuont is amended to read as follows
Section 2-120 Disposition to government, governmental agencies, nonprofit
oreanizations, and affordable housing developers
(a) Notw•ithstandingatiy limitations to the contrary, the council may, by
resolution approved by a maJonty of its members, direct the finance
director to negotiate the disposition of real property by •

agenctes authorized to hold lands to fee stmple, to nonprofit
orRantzattons to develop affordable houstng or to affordable houstng

on such terms and conditions as deemed proper,
