BE IT ORDAINED BY THE COUNTY COUNCIL OF THE COUNTY OF HAWAII, STATE OF HAWAII: SECTION 1. TITLE This Ordinance shall be known as the Kailua Village Special District and Urban Design Review Commission. SECTION 2. PURPOSE AND APPLICABILITY The purpose of this Commission is to advise the Planning Department in matters concerning the design of buildings and structures and all public and private improvements within the village of Kailua. Kailua Village as used herein shall refer to that area bounded by the following: a. Beginning at a point on the shoreline approximately 4,000 feet west of the old Kailua wharf, mauka along the west boundary of TMK: 7-5-05:10 & 68 to the north- west corner of TMK: 7-5-05:68; b. Southeast and east along the mauka boundary of the existing RS -10 zone to the southwest corner of TMK: 7-5-05:62; C. Mauka along the west side of the existing V-.75 and CV -10 zones to Kuakini Highway; d. Mauka, crossing Kuakini Highway and along the west side of the existing CV -10 zone to the makai side of the Queen Kaahumanu Highway; -1- e. Southwest along the makai side of the Queen Kaahumanu Highway and its extension to the south side of the "Kona Hillcrest Subdivision"; f. Makai along the south side of the "Kona Hillcrest Subdivision" and along the south side of the parcels described as TMK: 7-5-30:23 & 24 to Kuakini Highway; g. Makai, crossing Kuakini Highway along the south side of the "Kona Lani Subdivision" and along the south side of the parcels described as TMK: 7-5-18:1, 4 & 61 to the shoreline; h. North along the shoreline to the point of beginning and containing an area of approximately 750 acres and as delineated on the attached map. SECTION 3. COMMISSION MEMBERSHIP The Commission shall consist of thirteen (13) appointive members who shall be appointed by the Mayor with the approval of the County Council. The appointive members shall be repre- sentative of the Kona District, provided that a minimum of 50% or seven (7) of the appointive members shall live and/or work in the Kailua Village for a minimum of two years prior to this appointment. The Commission shall also reflect a cross- section of labor, business including tourism and agriculture, and the village's property owners interests. There shall also be at least one person with a design background on the Commission. The members shall serve staggered terms of four (4) years, provided that of the first members appointed, seven (7) shall serve for four (4) years and six (6) shall serve for two years. When the term of a member expires, he shall continue to serve until his successor is appointed. -2- The appointive members may be removed upon recommendation by the Mayor with the approval of the Council. No appointive member shall be eligible for a second appointment, provided that those serving for no more than two years shall be eligible to succeed themselves for an additional term. All members shall be vested with the right to vote. All provisions of Section 13-2 of the County Charter relat- ing to Boards and Commissions, except as otherwise provided herein, shall apply to the Commission. SECTION 4. RULES OF PROCEDURE The Commission shall prepare rules of procedure relating to matters within its jurisdiction. SECTION 5. POWERS AND DUTIES OF THE COMMISSION a. The Commission shall recommend to the Planning Depart- ment an architectural and design concept of theme for Kailua Village that recognizes the desires and concerns of all public and private interests. b. The Commission shall provide an architectural and design review of applications requiring "Plan Approval" by the Planning Department. The Commission's review and recommendations to the Planning Department shall be completed within one month or thirty (30) calendar days from the date of the Commission's receipt of the plans requiring "Plan Approval." If a recommendation is not received within the allotted period, the Planning Department shall continue to process the request for "Plan Approval." C. The Commission shall provide an architectural and design review of all planned public improvements such as street -3- widening, street lights, and so forth, as well as all private improvements such as landscaping, structural painting, or any activity which will alter the physical appearance of Kailua Village. The recommendations shall be forwarded to the Planning Department within thirty (30) calendar days from the Commission's receipt of the proposal. If a recommendation is not received within the allotted period, the Planning Department shall continue to process the proposed activity. d. All of the Commission's advice and recommendations to the Planning Department shall be consistent with the provisions of the County Charter, General Plan, Zoning and all other related ordinances and any publicly -funded master plan developed for Kailua Village. SECTION 6. AMENDMENT The Kailua Village Special District boundaries as described in Section 2 shall be subject to review every five (5) years by the County Council and may be amended thereof. SECTION 7. EFFECTIVE DATE This Ordinance shall take effect upon approval.
