HomeMy WebLinkAboutORD 1975-088BILL NO. 70 AMENDED COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO. ~7CT ORDINANCE AMENDING CHAPTER 8 (ZONING CODE), HAWAII COUNTY CODE, AS AMENDED, ADOPTING REGULATIONS FOR INTENSIVE AGRICULTURAL DISTRICTS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 8, Hawaii County Code, as amended, is hereby amended by adding thereto Article 18 to read as follows: "ARTICLE 18 "Regulations for IA, Intensive Agricultural Districts "SEC. 1. PURPOSE AND APPLICABILITY "This district provides for the preservation of high productive lands for agricultural purposes as provided for in the County General Plan. "It applies to rural areas of good agricultural lands and the intervening gullies and steep slopes which are not subject to urbanization or higher density uses as spelled out in the General Plan. "SEC. 2. PERMITTED USES "A. Single-family dwellings (only one per building site). "B. Sugar growing. "C. Orchards. "D. Diversified agriculture - the growing and gathering of crops, fruits, vegetables, flowers, and other plants. "E. Processing, storage, packing, shipping and sales of products produced on the premises provided the site or building used for such activity shall be at least one hundred (100) feet from any property line. "F. Piggeries, apiaries, and penfeeding of livestock when not closer than 1,000 feet to any major road or to any district other than 'U' or 'A' on site approved by the Health Department and the Director. "G. In areas over 30 per cent slope and in gullies within this district where rough terrain discourages intensive agricultural uses, the Director may approve any other uses as listed under 'RA' or 'A' districts. "H. Use and buildings normally considered accessory to the above permitted uses subject to the approval of the Director. "SEC. 3. HEIGHT LIMITS "Same as in 'A' districts except that the Director may permit by 'Plan Approval' any farm structures to be built to a height of one-hundred (100) feet, which action need only to determine that the extra height is necessary. "SEC. 4. MINIMUM BUILDING SITE AREA AND DISTRICT DESIGNATION "A. Same as in 'RA' districts except the symbol 'IA' shall be used. "B. The minimum area to be designated for any 'IA' district shall be three (3) acres up to a maximum of ten thousand (10,000) acres. "SEC. 5. MINIMUM BUILDING SITE AVERAGE WIDTH "Same as in 'A' districts. "SEC. 6. MINIMUM YARDS "Same as 'A' districts. -2- "SEC. 7. OTHER REGULATIONS (See Article 26) "If any building site in any IA district has an area of less than three (3) acres, the minimum yards shall be the same as in a RA district having an area requirement nearest that of the subject building site." SECTION 2. This ordinance shall take effect upon its approval.
