Section 7.02 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: 7.02(PP)• The district classification of the following area situated at Kealakehe Homesteads, North Kona, Hawaii, shall be Single Family Residential (RS-10); Beginning at the South corner of this parcel of land, on the Easterly side of Tomi Tomi Road, the coordinates of said point of beginning referred to Government Survey Triangulation Station "LAPAUWILA" being 2,141.35 feet North and 1,199.36 feet East and running by azimuths measured clockwise from true South: 1. 132° 36' 99.67 feet along the Easterly side of Tomi Tomi Road; 2. 188° 43' 68.83 feet along the Easterly side of Homestead Road to a spike found; 3. 246° 49' 155.00 feet following stonewall and along Grant 3742 to J. R. Kailiuaua; 4. 338° 55' 115.80 feet following stonewall and along Grant 3742 to J. R. Kailiuaua; 5. 53° 52' 30.. 150.06 feet following stonewall and along Grant 3742 to J. R. Kailiuaua to the point of beginning and con- taining an area of 22,812 Square Feet or 0.524 Acres. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the applicant, Easy Pipella, submit a sub- division plan and secure tentative approval within one (1) year of the official date of approval of the change of zone request; and (B) construction of a single-family dwelling commence on one (1) of the lots within three (3) years of receipt of final subdivision approval. Should any of the fore- going conditions not be met, rezoning of the property to its former zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
