BILL NO. 101 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO. .~ B AN ORDINANCE AMENDING SECTION 7.29, THE CITY OF HILO ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-3a) TO SINGLE FAMILY RESIDEN- TIAL (RS-10) AT WAIAKEA, SOUTH HILO, HAWAII, COVERED BY TAX MAP KEY 2-4-03:18. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.29 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.29( dd). The district classification of the following area situated at Waiakea, South Hilo, Hawaii, shall be Single Family Residential (RS-10): Beginning at the Northwest corner of this parcel of land on the South side of Kawailani Street, the coordinates of which referred to Govern- ment Survey Triangulation Station "HALAI" being 12,327.56 feet South and 424.53 feet East and running by azimuths measured clockwise from true South: 1. 265° 40' 968.00 feet along the South side of Kawailani Street; 2. 355° 40' 1800.00 feet along Grant 12412 to Charles Y. and Yaeko T. Narimatsu, Grant 11310 to Miss Angeline Oliveria and portion of Grant 11418 to James M. McSwanson; 3. 85° 40' 968.00 feet along Grant 11635 to Everett A. Crumb and Rita Florence Crumb; 4. 175° 40' 1800.00 feet along Grant S-14189 to Helen K. Kaina and Grant 5-15040 to Bishop Trust Co. Ltd., Executor of the Estate of Helen K. Kaina, deceased to the point of beginning and containing an area of 40.000 Acres. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) the area be zoned in two (2) increments. The first increment shall consist of a maximum of twenty-five (25) acres and the second, the remaining area. The effective date of zoning for the second increment shall be after development has occurred on the first increment. Development is defined as building permits issued for residential dwelling units and construction partially completed - partially completed in the sense of having roofs on a minimum of twenty-five (25) percent of the units for the entire area of forty (40) acres; (B) the applicant, Kuulei Associates, in behalf of Yoshio Tomori, et al., submit a subdivision plan for Increment 1 and secure tentative approval within one (1) year from the date of approval of the change of zone and also assume the responsibility of securing final subdivision approval for the first increment. The applicant shall also be responsible for obtaining final subdivision approval of the second increment. All other concerns, such as drainage, shall be considered at the time of subdivision approval; (C) the applicant, Kuulei Associates, provide a cash contribution of thirty-five thousand dollars ($35,000.00) to the County of Hawaii. Said funds shall be expended by the County to further the area's park and recreational development program; (D) curbs, gutters, and sidewalks be constructed within the proposed subdivision; and (E) a ten (10) foot strip along Kawailani Street be set aside for future road widening of Kawailani Street to a 60-foot right-of-way as stipulated in the Hawaii County General Plan document. Should the foregoing conditions not be met, rezoning of the property to its original zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
