AN ORDINANCE AMENDING SECTION 7.05, THE KAILUA-HONALO URBAN ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE FAMILY RESIDENTIAL (RS-10) TO MULTIPLE FAMILY RESIDENTIAL (RM-1.5) AT KEAUHOU 1ST, NORTH KONA, HAWAII, COVERED BY TAX MAP KEY 7-8-12:32. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.05 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.05(q ). The district classification of the following area situated at Keauhou 1st, North Kona, Hawaii, shall be Multiple Family Residential (RM-1.5): Beginning at a pipe in concrete at the southeast corner of this parcel of land, the coordinates of which referred to Government Survey Triangulation Station "KEAUHOU COAST" being 3586.80 feet North and 1532.66 feet East, and thence running by azimuths measured clockwise from true South: 1. 86° 45' 82.56 feet along the northerly side of a Roadway, to a pipe in concrete; 2. 171° 00' 43.00 feet along R. P. 7387, L. C. Aw. 7738:2 to Aoao, to a pipe in concrete; 3. 77° 45' 39.73 feet along R. P. 7387, L. C. Aw. 7738:2 to Aoao, to a pipe in concrete, marked 60 (found); 4. 175° 34' 30" 174.28 feet along Lots 4 and 3 of the "KEAUHOU BAY LOTS" along R. P. 4475, L. C. Aw. 7713:7 to V. Kamamalu, to a pipe in concrete, marked 59 (found); 5. 256° 42' 162.88 feet along Lots 2 and 1 of the "KEAUHOU BAY LOTS" along R. P. 4475, L. C. Aw. 7713:7 to V. Kamamalu, to a pipe in concrete, marked 58 (found); 6. 5° 30' 184.42 feet along the westerly side of the Kamehameha III Road, to a pipe in concrete; 7. 359° 24' 30" 57.02 feet along the westerly side of the Kamehameha III Road to the point of beginning and containing an area of 0.683 Acre. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) construction commence within one (1) year of the date of approval of the change of zone; (B) the disposal of sewage shall meet with the rules and regulations of the State Department of Health; and (C) all other applicable rules and regulations including the "Plan Approval" process, be complied with. Should any of the foregoing conditions not be met, rezoning of the property to its original zoning designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
