AN ORDINANCE AMENDING SECTION 7.03, THE SOUTH KONA ZONE MAP OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE FAMILY RESIDENTIAL (RS-10) TO MULTIPLE FAMILY RESIDENTIAL (RM-7) AT KEALAKEKUA, SOUTH KONA, HAWAII, COVERED BY TAX MAP KEY 8-2-02:23, 27, 43 & PORTIONS OF 3-8, 11, 17, 24, 26, 29 & 30. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.03 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.03(p ). The district classification of the following area situated at Kealakekua, South Kona, Hawaii, shall be Multiple Family Residential (RM-7): Beginning at the north corner of this parcel of land on the south- westerly side of Hawaii Belt Road, the coordinates of said point of beginning referred to Government Survey Triangulation Station "PUU OHAU" being 7,420.22 feet south and 13,569.48 feet east, and thence running by azimuths measured clockwise from true South: 1. 311° 55' 30" 2. 305° 52' 43" 544.26 feet along the southwesterly side of Hawaii Belt Road; Thence along the southwesterly side of Hawaii Belt Road on a 985.37 foot radius curve to the left, the chord azimuth and distance being: 207.58 feet; Thence along remainder of R. P. 3607 and 7533, L. C. P..w. 8452:9 to A. Keohokalole for the following five (5) courses: 3. 46° 27' 4. 315° 42' 5. 336° 48' 6. 354° 13' 30" 7. 264° 13' 30" 128.42 feet; 150.35 feet; 145.01 feet; 105.00 feet; 162.21 feet; Thence along remainder of R. P. 3607 and 7533, L. C. Aw, 8452:9 to A. Keohokalole on a 525.00 foot radius curve to the right, the chord azimuth and distance being: 8. 282° 58' 30" 337.51 feet; 9. 301° 43' 30" 524.90 feet along remainder of R. P. 3607 and 7533, L. C. Aw. 8452:9 to A. Keohokalole; Thence along stonewall, along Grant 867 to Preston Cumings at Kiloa for the following eight (8) courses: 10. 46° 27' 30" 48.30 feet; 11. 48° 45' 103.13 feet; 12. 51° 25' 109.39 feet; 13. 49° 24' 135.79 feet; 14. 40° 30' 30" 127.13 feet; 15. 45° 20' 268.49 feet; 16. 52° 11' 68.57 feet; 17. 52° 03' 65.95 feet; Thence along remainder of R. C. Aw, 8452:9 to Keohokalole; Thence along remainder of R. P. 3607 and 7533, L. C. Aw. 8452:9 to A. Keohokalole on a 400.00 foot radius curve to the right, the chord azimuth and distance being: 24. 143° 15' 223.86 feet, thence 25. 159° 30' 270.00 feet along remainder of R. P. 3607 and 7533, L. C. Aw, 8452:9 to Keohokalole; Thence along remainder of R. P. 3607 and 7533, L. C. Aw, 8452:9 to A. Keohokalole, on a 300.00 foot radius curve to the right, the chord azimuth and distance being: 26. 188° 48' OS" 293.64 feet to the point of beginning and containing an area of 21.187 acres. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) a Planned Unit Development application be processed and approved prior to construction of any new facilities on the subject area; (B) the applicant, Gentry-Hawaii, Ltd., submit a consolidation and resubdivision plan and secure tentative approval within one (1) year from the date of approval of the change of zone. The applicant shall also be responsible for securing final subdivision approval; (C) all historical or archaeological features within the area be preserved and/or restored; and (D) the method of sewage disposal shall conform to the rules and regula- tions of the State Department of Health. Should any of the foregoing conditions not be met, rezoning of the property to its original zoning designation may be initiated. -3- SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
