AN ORDINANCE AMENDING SECTION 7.07, THE HAWI-KAPAAU ZONE MAP, OF CHAPTER 8 (ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE FAMILY RESIDENTIAL (RS-15) TO VILLAGE COMMERICAL (CV-10) AT PUEHUEHU, NORTH KOHALA, HAWAII, COVERED BY TAX MAP KEY 5-4-07:48 & 5-4-10:17. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 7.07 of Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as amended, is hereby further amended by adding thereto the following subsection: "7.07( b). The district classification of the following area sit- uated at Puehuehu, North Kohala, Hawaii, shall be Village Commercial (CV-10): Beginning at the northeasterly corner of this parcel of land, on the westerly side of Union Mill Road, the coordinates of said point of beginning referred to Government Survey Triangulation Station "PUU- 0-NALE," being 12,521.37 feet North and 10,537.06 feet East, thence running by azimuths measured clockwise from true South: 1. 16° 26' 133.26 feet along the westerly side of Union Mill Road; Thence along the westerly side of Union Mill Road on a curve to the right with a radius of 40.00 feet, the direct chord azimuth and dis- tance being: 2. 65° 09' 13.8" 60.12 feet; Thence along the northerly side of Hawi-Niulii Road on a curve to the right with a radius of 5,694.58 feet, the direct chord azimuth and distance being: 3. 114° 41' 43.8" 4. 205° 31' 5. 196° 26' 6. 286° 26' 163.23 feet; 42.53 feet; 107.47 feet; 200.00 feet to the point of beginning and containing an area of 32,723 square feet. "All as outlined in red on the map attached hereto, marked Exhibit 'A' and by reference made a part hereof." SECTION 2. Section 1 of this ordinance shall take effect forthwith upon the conditions that (A) construction of the proposed building com- mence within one (1) year from the date of approval of the request; and (B) all applicable Rules and Regulations, including the "Plan Approval" process be complied with. Should any of the foregoing conditions not be met, rezoning of the property to its former designation may be initiated. SECTION 3. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. SECTION 4. This ordinance shall take effect upon its approval.
