AN ORDINANCE AMENDING SECTION 7.29, THE CITY OF HILO ZONE MAP CHAPTER 8
(ZONING CODE), ARTICLE 2, HAWAII COUNTY CODE, AS AMENDED, BY CHANGING
THE DISTRICT CLASSIFICATION FROM AGRICULTURAL (A-20a) TO SINGLE FAMILY
RESIDENTIAL (RS-10) AT KUKUAU 2ND SOUTH HILO, HAWAII, COVERED BY TAX
MAP KEY 2-5-51:3.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Section 7.29 of Chapter 8 (Zoning Code), Article 2,
Hawaii County Code, as amended, is hereby further amended by adding
thereto the following subsection:
"7,29(gg ). The district classification of the following
area situated at Kukuau 2nd, South Hilo, Hawaii, shall be Single
Family Residential (RS-10):
Beginning at the Southwest corner of this parcel of land, being
also the Northwest corner of Lot 1, File Plan 1257, Hilo Country
Club Estates, Unit 1, the coordinates of said point of beginning
referred to Government Survey Triangulation Station "KAUMANA"
being 2385.10 feet South and 3455.44 feet West, thence running
by azimuths measured clockwise from True South:
1. 180° 00' 155,51 feet along the East side of Parcel 12,
Wilder Road Improvements;
2. 268° 25' 102.15 feet along the remainder of R,P. 5706,
L. C . Aw. 8 521-B, Apana 2 to G. D. Hueu;
3. 180° 00' 30.88 feet along same;
4. 270° 00' 32.00 feet along same;
5. 360° 00' 30.00 feet along same;
6. 268° 25' 15.62 feet along same;
7. 360° 00' 159.65 feet along Lots 6, 5, and 4, File Plan
1257 , Hilo Country Club Estates, Unit 1;
8. 90° 00' 149.72 feet along Lots 1 and 2, File Plan 1257,
Hilo Country Club Estates, Unit 1, to
the point of beginning and containing an
area of 24 ,567 square feet.
"All as outlined in red on the map attached hereto, marked
Exhibit ' A' and by reference made a part hereof."
SECTION 2. Section 1 of this ordinance shall take effect forthwith
upon the conditions that (A) the applicants, Stuart Oda and others, submit
a subdivision plan and secure tentative approval within one (1) year of
the date of approval of the change of zone request. The applicant shall
also be responsible for securing final subdivision approval; and (B)
construction of another single family dwelling commence within three (3)
years of receipt of final subdivision approval. Should any of the fore-
going conditions not be met, rezoning of the property to its original
zoning designation may be initiated.
SECTION 3. In the event that any portion of this ordinance is
declared invalid, such invalidity shall not affect the other parts of
this ordinance.
SECTION 4. This ordinance shall take effect upon its approval.

The subject parcel is adjacent to the Hilo Cot:ntry Cluh T'states
Subdivision which is comprised of a large number of single family
residences, It is already a single family residential parcel and
keeping it as an A-20(a) designation would be meaningless,

(1) Since the parcel is comprised of 24,567 so, feet, ~~re intend to
subdivide the parcel into two lots; one of 13,219 sq, feet and
the other with the dwelling already on it of 11,348 sq. feet,
(2) The State Land Use Commission has recentl~r, on December 18, 1974,
approved the rezoning of the area from Agricultural to Urban,

This Bill amends Section 7.29, the City of Hilo Zone Map
Chapter 8 (Zoning Code), Article 2, Hawaii County Code, as
amended, by changing the district classification from Agricultural.
(A-2.Oa) to Single Family Residential CRS-10) at Kukuau 2_nd,
S. Hilo.
Date Introduced: May 21, 1975
