BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. The following sums enumerated herein, estimated for the fiscal period July 1, 1975 to June 30, 1976, are hereby provided and appropriated to the projects herein contained, from monies in the treasury received from general revenues, highway, sewer fund, parking meter funds, and revenue sharing. The Director of Finance is hereby authorized and directed to set up appropriate accounts for each project and is hereby authorized to make monies available either through available funds or floating general obligation bonds for the planning, land acquisition and/or construction of projects as listed under Section 1. SECTION 3. The appropriation and authorization in Section 1 include land purchase, plans, site preparation, improvements to land, construction and necessary equipment. SECTION 4. The Mayor, upon recommendation of the Planning Director, the Director of Finance, and the Depart- ment Head of the designated expending agency, shall determine when the authorized projects shall be initiated, taking into consideration the factors of public need, general financial condition of the county general fund, highway fund, sewers fund, parking meter fund and revenue sharing, and the general economic condition. The Mayor shall have authority to defer projects for reconsideration of the Council whenever it is determined that the fiscal and economic condition does not warrant expenditure of the appropriated funds. SECTION 5. The Contingency Fund is hereby appropriated to the Mayor's Office for adjustment purposes for the projects authorized. We have discussed this matter with the Corporation Counsel's Office, and have their concurrence relative to form and legality. The approved amendments are listed as follows: 1. Article 2. Section 1-E V7here land is subdivided, the provisions of this chapter shall apply to all vacant lots thus created, except those previously assessed. 2. Article 2, Section 4-C The approved deviations or that portion which is the difference between the land area required under Article 2, Section 4-A and the land area dedicated or provided in perpetuity, shall be exempt from the fee requirement of Article 2, Section 5. 3. Article 2, Section 4-D Land and building subdivisions involving ten (10) lots/units or less and all vacant lots and/or new units falling under the pur- view of Article 2., Sections 1-F and 1-G shall be required the payment of fees only in the amount of $250 per lot/unit; provided, sed subdivision does not reAresent the maximum reasiple aevelo~: nt uossible for the subject land as determined by the Director. Prior to preliminary approval of a land subdivision or preliminary plan approval of a building subdi- vision, upon concurrence by the Director of Parks and Recreation, the Planning Director shall determine whether to require a dedi- cation or provision of land in perpetuity, payment of a fee, or a combination or provision of land in perpetuity and payment of fee.
